AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, ESTABLISHING
A MAXIMUM LAWFUL PRIMA FACIE SPEED LIMIT IN SCHOOL ZONES OF TWENTY
(20) MILES PER HOUR; PROVIDING FOR SCHOOL ZONES ON NASH DRIVE FROM
A POINT SIX HUNDRED FEET (6001) WEST OF ITS INTERSECTION WITH JOHN
YATES STREET TO THE POINT OF ITS INTERSECTION WITH MILLER DRIVE,
ON JOHN YATES STREET FROM A POINT FOUR HUNDRED AND TEN FEET (410')
SOUTH OF ITS INTERSECTION WITH NASH DRIVE TO THE POINT OF ITS IN-
TERSECTION WITH NORTH COLONY BOULEVARD, AND ON NORTH COLONY BOULE-
VARD FROM THE POINT OF ITS INTERSECTION WITH JOY LAI4E TO ONE HUNDRED
FEET (100') EAST OF THE POINT OF ITS INTERSECTION WITH RAGAN DRIVE BE-
TWEEN THE HOURS OF SEVEN -THIRTY (7:30) A.M. TO NINE (9:00) A.M. AND
TWO -THIRTY (2:30) P.M. TO FOUR (4:00) P.M. ON SCHOOL DAYS; PROVIDING
FOR, THE ERECTION OF SIGNS; PROVIDING A SEVERABILITY CLAUSE; PRO-
VIDING FOR, A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED
DOLLARS ($200.00) FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF' THE CITY OF THE COLONY,
TEXAS:
SECTION 1. That the City Council intends by this ordinance to
create certain areas on designated streets within the City to be
known as school zones. The City Council finds that such areas con-
stitute areas hazardous to school children on school days during
certain hours.
SECTION 2. From and after the passage of this ordinance and the
erection of signs as provided herein, it shall be unlawful for any
person to drive or operate any motor vehicle on the hereinafter
described streets at a speed greater than twenty (20) miles per hour
between the hours of seven -thirty (7:30) a.m. to nine (9:00) a.m. and
two -thirty (2:30) p.m. to four (4:00) p.m. on school days, and any
speed greater than twenty (20) miles per hour is declared to be un-
reasonable and imprudent under the cirsumstances then existing because
of the special hazard existing in the areas described hereafter
during such hours. Such speed is further declared to be the maxi-
mum lawful prima facie speed limit and any evidence of any speed
in excess of such limit shall be prima facie evidence that such
speed is not reasonable or prudent and that it is unlawful.
SECTION 3. The extent of such school zones shall be as follows;
(a) On Nash Drive from a point six hundred feet (600') west
of the point of its intersection with John Yates Street to the point
of its intersection with Miller Drive.
(b) On John Yates Street from a point four hundred and ten
feet (4101) south of the point of its intersection with Nash Drive
to the point of its intersection with North Colony Boulevard.
(c) On North Colony Boulevard from the point of its in-
tersection with Joy Lane to a point one hundred feet (100') east
of the point of its intersection with Ragan Drive.
SECTION 4. The City Manager or his duly authorized repre-
sentative is directed to erect appropriate signs giving notice of
the times and limits of such school zones in accordance with the
Texas Uniform Manual on Traffic Control Devices.
SECTION 5. The provisions of this ordinance are severable,
and should any section, paragraph, sentence, clause or phrase
hereof be declared unconstitutional or void, such declaration shall
not effect any of the remaining portions hereof.
SECTION 6. Any person violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor and, upon con-
viction in the Municipal Court of the City of The Colony, Texas, shall
be fined in an amount not to exceed the sum of Two Hundred Dollars
($200.00) for each offense.
SECTION 7. This ordinance shall take effect immediately from
and after its passage and the publication of the caption, as the law
and charter in such cases provide, provided, however, that the
speed limits established herein for the school zones as described
shall not be effective until appropriate signs are erected and in
place giving motorists notice of such limits.
