AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING OR-
DINANCES 11, 12 AND 23 TO PROVIDE INDEFINITE TERMS OF OFFICE FOR
THE CITY SECRETARY, THE CHIEF OF POLICE AND THE MUNICIPAL JUDGE;
AMENDING ORDINANCE NUMBER 15 TO PROVIDE FOR FIVE (5) MEMBERS OF
THE PARK AND RECREATION BOARD AND TO PROVIDE Two (2) YEAR TERMS;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1. Ordinance Number 11 is hereby amended by amending
Section 3 thereof to provide that the City Secretary shall be ap-
pointed for an indefinite term and shall serve at the pleasure of
the Council. Section 4 shall be amended to provide that "In the
event of temporary absence or inability to serve of such Secretary,
his deputy or deputies as have been appointed by the City Council
may so serve; or, the City Council may appoint a suitable and quali-
fied person as acting City Secretary to serve for such period of
temporary absence or inability to serve. Provided, that the acting
Secretary if so appointed, shall duly take the oath of City Secretary
of the City of The Colony."
SECTION 2. Ordinance Number 12 is hereby amended by amending
Section 2 to provide that office of Chief of Police shall be filled
by appointment by the City Manager with the approval of the City Council
for an indefinite term. Section 5 thereof shall be amended to provide
"In the event of temporary absence or inability to serve of such Chief
of Police, the City Manager with the approval of the City Council may
appoint a suitable and qualified person as acting Chief of Police to
serve for such period of temporary absence or inability to serve. Pro-
vided, that such acting Chief of Police, if so appointed, shall duly
take the oath of Chief of Police of the City of The Colony."
SECTION 3. Ordinance Number 23 shall be amended to provide that
the Judge of the Municipal Court shall be appointed by the City Council
and shall serve at the pleasure of the Council. Section 4 thereof
shall be amended to provide that "In the event of temporary absence
or inability to serve of such Judge, the City Council may appoint a
suitable and qualified person as Temporary Judge to serve for such
period of temporary absence or inability to serve. Provided, that
such Temporary Judge, if so appointed, shall duly take the oath of
Temporary Judge of the Municipal Court."
SECTION 4. That Ordinance 15 is amended by amending Section 1.03(a)
to provide that the Park and Recreation Board shall consist of five (5)
members. That Section 1.03(c) shall provide that members of the Park
and Recreation Board shall be appointed by the City Council, the
initial term of two (2) of such members shall be until April 1, 1980,
and the initial term for three (3) of such members shall be until
April 1, 1981. Thereafter, appointments shall be for two (2) year
periods.
SECTION 5. The provisions of this Ordinance are severable, and
should any section, paragraph, sentence, clause or phrase hereof be
declared unconstitutional, such declaration shall not effect any of
the remaining portions hereof.
SECTION 6. This Ordinance shall take effect immediately from and
after its passage and the publication of the caption, as the law and
charter in such cases provide.
