HomeMy WebLinkAboutOrdinance No. 60ORDINANCE NO. �J AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, ADOPTING THE UNIFORM PLUMBING CODE, 1976 EDITION, OF THE INTERNATIONAL ASSOCIATION OF PLUMBING AND MECHANICAL OFFICIALS; ADOPTING THE NATIONAL ELECTRICAL CODE, 1978 EDITION, OF THE NATIONAL FIRE PROTECTION ASSOCIATION; ADOPTING THE UNIFORM MECHANICAL CODE, 1976 EDITION, OF THE INTERNATIONAL ASSOCIATION OF PLUMBING AND MECHANICAL OFFICIALS; PROVIDING FOR PERMIT FEES; PROVIDING A SEVERABILITY CLAUSE; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the Uniform Plumbing Code, 1976 Edition, of the International Association of Plumbing and Mechanical Officials, is hereby adopted as the Plumbing Code of the City of the Colony. A true copy of the Code is attached hereto as Exhibit "A" and made a part hereof for all purposes. Additional copies shall be available in the office of the City Secretary for inspection by any person at any time during regular business hours. SECTION 2. That the National Electrical Code, 1978 Edition, of the National Fire Protection Association, is hereby adopted as the Electrical Code of the City of the Colony. A true copy of the Code is attached hereto as Exhibit "B" and made a part hereof for all purposes. Additional copies shall be available in the office of the City Secretary for inspection by any person at any time during regular business hours. SECTION 3. That the Uniform Mechanical Code, 1976 Edition, of the International Association of Plumbing and Mechanical Officials, is hereby adopted as the Mechanical Code of the City of the Colony. A true copy of the Code is attached hereto as Exhibit "C" and made a part hereof for all purposes. Additional copies shall be available in the office of the City Secretary for inspection by any person at any time during regular business hours. SECTION 4. That the fee schedule set out in Table 3-A, Section 303, of the Uniform Building Code, as adopted in Ordinance 21 of the City of the Colony,is hereby amended to provide that each application for a building permit for construction of a single family residence shall be accompanied by a permit fee of one hundred and sixty dollars ($160.00). Such permit fee shall cover all fee requirements for such single family residence for the permits required in the Uniform Building Code, the Uni- form Mechanical Code, the Uniform Plumbing Code and the National Electrical Code. That the other fees provided in the Uniform Building Code, the Uniform Mechanical Code and the Uniform Plumbing Code shall be as set out therein. Fees for electrical permits for construction other than new single family residences shall be at the rate of $.009 per square foot of construction. SECTION 5. Should any Section, Subsection, sentence, clause, or phrase of the Codes adopted by this Ordinance be declared to be invalid for any reason, such declaration shall not effect the validity of the remaining portions of such Codes as adopted, which portions shall remain severable. SECTION 6. Any Ordinance or any portion of any Ordinance of the City of the Colony in conflict with any portion of this Ordinance or the Codes adopted hereby is hereby repealed. SECTION 7. Any person, firm or corporation violating any of the provisions of the Uniform Plumbing Code, the National Electrical Code, or the Uniform Mechanical Code as adopted herein shall be deemed guilty of a misdemeanor and, upon conviction in the Municipal Court of the City of the Colony, Texas, shall be subject to a fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense, and each and every day any such offense shall continue shall be deemed to constitute a separate offense. -2- SECTIO14 8. This Ordinance shall take effect immediately from and after its passage on second and final reading, and the publication of the caption as the law and Charter in such cases provide.
