AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, CONTINUING
THE IMPOSITION OF THE ONE PERCENT (1%) CITY SALES TAX ON RESI-
DENTIAL USE OF GAS AND ELECTRICITY; PROVIDING FOR THE FURNISH-
ING OF A COPY OF THE ORDINANCE TO THE COMPTROLLER OF PUBLIC
ACCOUNTS BY CERTIFIED MAIL; PROVIDING FOR A REFERENDUM ELECTION
IN APRIL, 1980; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the 65th Legislature of the State of Texas has en-
acted legislation providing a local option on the one percent
(1%) city sales tax on the residential use of gas and electricity,
and
WHEREAS, the City Council has determined that it is in the
best interest of the City to continue such one percent (1%) city
sales tax, and
WHEREAS, the City Council has determined that the question
of continuation of the city sales tax on residential use of gas
and electricity should be submitted to a referendum of the people
in the next regular city election, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1. The City Council of the City of the Colonv hereby
continues the imposition of the one percent (1%) city sales tax
on the residential use of gas and electricity within the corporate
limits of the City.
SECTION 2. The City Secretary is hereby directed to furnish
a certified copy of this ordinance to the Comptroller of Public
Accounts of the State of Texas by certified mail no later than
May 1, 1979.
SECTION 3. The question of whether or not the imposition of
the one percent (1%) city sales tax on the residential use of gas
and electricity shall be submitted to a referendum of the people
at the next regular municipal election in April, 1980.
SECTION 4. This ordinance shall take effect immediately
from and after its passage and the publication of the caption as
the law and charter in such cases provide.
