AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AUTHORIZING
THE CITY MANAGER TO ENTER INTO A CONTRACT FOR CONSULTANT SER-
VICES; ATTACHING THE APPROVED FORM OF THE CONTRACT AS EXHIBIT
"A"; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS:
SECTION 1. That the City Manager of the City of the Colony,
Texas, is hereby authorized to execute, on behalf of the City
of the Colony, a contract for engineering services in connection
with the handling of the appeal of Lone Star Gas Company to the
Texas Railroad Commission in Gas Utilities Docket No. 1880 with
Joe M. Nall & Associates, Inc., Consulting Engineers. The ap-
proved form of such contract is attached hereto as Exhibit "A"
and made a part hereof for all purposes.
SECTION 2. This Ordinance shall take effect immediately
from and after its passage and the publication of the caption,
as the law and Charter in such cases provide.

PROJECT: Domestic Gas Rate Analysis
SCOPE OF SERVICES:
JMN Job No. 01 -79 -GC
To provide expert assistance to the City of The Colony in analyzing the request
of Lone Star Gas Company for approval of an increase in gas rates for residential and
commercial customers, reviewing the City's rate relief action on appeal to the State
Railroad Commission and preparing direct testimony.
These services are to be provided at the direction of the City Administrator and
shall include but not be limited to: Analyses of the applications and requests of
Lone Star Gas Company for the determination of the proper rate base, revenues and ex-
penses and rate of return that should be utilized in determintng.fai:r.;actd equitable
charges for domestic gas consumption in The Colony.
The Consulting Engineer's findings and -recommendations shall be set forth in
.testimony and exhibits type report to the City for trans.mital to the Gas Utilities
Division of the Railroad Commission of Texas within a reasonable period of time after
all necessary underlying records, documents and other information supplied by the
Company to the City have been reviewed by the Consultant. An independent study of the
gas distribution plant condition will not be performed by the Consultant if the age and
condition of the plant is considered to be in 85% of new condition. !
The Consulting Engineer shall make available to the City expert witness to present
testimony before the Railroad Commission of Texas. 1
BILLING AND ACCOUNTING DATA:
For services rendered, the Client shall pay Joe M. Nall & Associates., Inc., Con-
sulting Engineers, upon submission of monthly invoices, an.amount equal.ao,'the actual
hours of services furnished multiplied by the product of the Consulting,Enginer's
established hourly salary cost, this expense shall come from current revenue or from
taxes which the municipality agrees to levy for the purpose of paying the same; or
from direct reimbursement of the Utility Company whose rate making proceedings are,being_
investigated in accordance with the 1975 Texas Public Utility Regulatory Act.
In addition, the Client shall reimburse the Consulting Engineer each month at cost
for all out-of-pocket expenses directly chargeable to the work. j
Unless prolonged by lengthy hearings the service billing of the Consulting
Engineer will be restricted to a maximum of $4,500.00
