HomeMy WebLinkAboutOrdinance No. 50ORDINANCE NO. ✓V AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF THE COLONY, AS HERE-- TOFORE AMENDED, SO AS TO CHANGE TRACT A FROM SINGLE FAMILY DISTRICT CLASSIFICATION TO OFFICE DISTRICT "O-1"; CHANGING TRACT B FROM SINGLE FAMILY DISTRICT CLASSIFICATION TO SHOPPING CENTER DISTRICT "SC"; CHANGING TRACT C FROM SINGLE FAMILY DISTRICT CLASSIFICATION TO GENERAL RETAIL DISTRICT "GR"; SAID TRACTS BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: TRACT A 'zk 11 0A Being a tract of land situated in the B.B.B. Survey, Abstract No. 194, Denton County, Texas and being more particularly described as follows: BEGINNING at the intersection of the north line of Colony Blvd. (a 100 ft. R.O.W.) and the east line of Paige Road (a 100 ft. R.O.W.); THENCE N 00 17' 55" W, 660.60 feet along the east line of Paige Road; THENCE N 890 42' 05" E, 256.94 feet; THENCE S 000 000 17' 55" E, 663.16 feet to a point in the north line of Colony Blvd.; THENCE N 890 43' 40" W, 256.95 feet along the north line of Colony Blvd. to the Place of Beginning and containing 3.904 acres of land. PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUN- DRED DOLLARS ($200.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission of the City of the Colony, Texas, and the City Council of the City of the Colony, in compliance with the laws of the State of Texas, and with the pro- visions of the Comprehensive Zoning Ordinance of the City of the Colony, have given the requisite notices by publication and other- wise, and after holding due hearings and affording a full and fair hearing to all property owners generally and to the persons interested and situated in the affected areas and in the vicinity thereof, the governing body of the City of the Colony is of the opinion that the zoning should be granted, NOW THEREFORE, BE IT ORDAINED by the City Council of the City of the Colony, Texas: SECTION 1. That the Comprehensive Zoning Ordinance of the City of the Colony, Texas, be, and the same is hereby,amended by amending the zoning man of the City of the Colony so as to change the following described property zoning classification from "Single Family District Classi- fication" to "Office District 0-11'. That the property is described as follows: TRACT A Being a tract of land situated in the B.B.B. Survey, Abstract No. 194, Denton County, Texas and being more particularly described as follows: BEGINNING at the intersection of the north line of Colony Blvd. (a 100 ft. R.O.W.) and the east line of Paige Road (a 100 ft. Hayes Survey, Abstract No. 648, Denton County, Texas, and being more particularly described as follows: BEGINNING at the intersection of the east line of Farm Road No. 423 and the south line of North Colony Blvd.; THENCE N 89 028' 35" E, along said south line, 455.55 feet; THENCE S 000 31' 25" E, 355.00 feet; THENCE in a southerly to westerly direction with a curve to the right, said curve having a central angle of 900 00' 00" and a radius of 40.00 feet, a distance of 62.83 feet; THENCE S 890 28' 35" W, 418.68 feet to a point in the ease line of Farm Road No. 423; THENCE N 000 22' 33" E, along said east line, 39.55 feet; THENCE N 000 07' 10" W, continuing along said east line, 355.46 feet to the Place of Beginning and containing 4.136 acres of land. That the Comprehensive Zoning Ordinance of the City of the Colony, Texas, be, and the same is hereby, amended by amending the zoning map of the City of the Colony so as to change the fol- lowing described property zoning classification from "Single Family District Classification" to "General Retail District 'GR". That the property is described as follows: TRACT C Being a tract of land situated in the S.E.Hayes Survey, Abstract No. 648, Denton County, Texas, and being more particularly described as follows: BEGINNING at the intersection of the north line of North Colony Blvd. and the east line of Farm Road No. 423; THENCE N 000 07' 10" W, along said east line 679.91 feet; THENCE N 890 52' 50" E, 260.00 feet; THENCE N 00 07' 10" W, 239.37 feet; THENCE S 890 58' 30" E, 915.91 feet to a point in the north line of North Colony Blvd.; THENCE S 890 28' 35" W, along said north line, 420.02 feet to the Place of Beginning and containing 7.420 acres of land. SECTION 4. That the herein described property shall be used only in the manner and for the purposes provided by the Comprehensive Zoning Ordinance of the City of the Colony, as heretofore amended, and as amended herein by the granting of this zoning classification. SECTION 5. That all ordinances of the City of the Colony in conflict with the provisions of this ordinance be, and the same are hereby, re- pealed, and all other provisions of the ordinances of the City of the Colony not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 6. That any person, firm or corporation violating any of the pro- visions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of the Colony and, upon conviction, shall be punished by a fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense, and each and every day such offense shall continue shall be deemed to constitute a separate offense. SECTION 7. This ordinance shall take effect immediately from and after its passage and the publication of the caption as the law in such cases provides.
