HomeMy WebLinkAboutOrdinance No. 29ORDINANCE _ 29 AN ORDINANCE DEFINING ALLEYS; SETTING A MAXIMUM SPEED LIMIT FOR ALLEYS; PROVIDING A SAVINGS CLAUSE FOR THE REPEAL OF ALL ORD- INANCES IN CONFLICT WITH THE PROVISIONS OF THIS ORDINANCE; PRO- VIDING FOR A SEVERABILITY CLAUSE; PROVIDING A PENALTY; AND PRO- VIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINNED BY THE CITY COUNCIL OF THE CITY OF THE COLONY: SECTION 1. Definitions A. Alley: Alleys are minor ways which are used primarily for vehicular service access to the back or the side of proper- ties otherwise abutting on a street. SECTION 2. Maximum Speed Limit The speed limit in alleys within the city limits shall be no greater than ten (10) miles per hour unless otherwise posted or zoned. SECTION 3. All ordinances and appropriations for which provi- sion has heretofore been made are hereby expressly repealed if in conflict with the provisions of this ordinance. SECTION 4. Should any part, portion, section or part of a section of this ordinance be declared invalid or inoperative or void for any reason by a court of competent jurisdiction, such de- cision, opinion, or judgement shall in no way effect the re- maining portion, parts, sections or parts of sections of this ordinance, which provisions shall be, remain and continue to be in full force and effect. SECTION 5. Penalty Any person, persons, firm, or corporation violating any provision or provisions of this Ordinance shall be deemed guilty of a misdemeanor, and shall, upon conviction, be fined in any sum not less than $1.00, nor more than $200.00; and, each day that violation continues shall be and constitute a separate offense. SECTION 6. That this ordinance shall take effect and be in full force and effect from and after the date of its passage SECTION 6. Con't. and publication as required by law.
