AN ORDINA14CE PROVIDING FOR FILLING THE OFFICE OF JUDGE OF THE
MUNICIPAL COURT BY APPOINTMENT AS AUTHORIZED BY LAW
WHEREAS, Article 1197a, Revised Civil Statutes as enacted
by House Bill No. 53, passed by the Regular Session of the
53rd Texas Legislature, 1953, authorizes the governing body of
Cities operating under the general laws to provide for the
filling of the office of Recorder of the Municipal Court by
Appointment, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1. That hereafter the office of Judge (formerly
Recorder) of the Municipal Court shall be filled by appoint-
ment by the City Council. The official title of such magistrate
shall be "Judge of the Municipal Court of the City of The
Colony, Texas."
SECTION 2. The Judge of the Municipal Court shall have
the powers and perform the duties as prescribed by the Laws of
the State of Texas, and by the Ordinances of the City of The
Colony, Texas.
SECTIO14 3. Said Judge shall be appointed for a term of
office running concurrently with that of the Mayor. He shall
receive such compensation as the City Council may fix by
Ordinance or Resolution, and shall furnish such surety bond
as may be required by the City Council, the premium to be paid
by the City. He may also be known and referred to as City
Judge or as City Recorder. He shall take the Oath required
by Law.
SECTION 4. In the event of temporary absence or inability
to serve of such Judge, the Mayor of the City of The Colony,
Texas, may so serve; or, the Mayor may appoint a suitable and
qualified person as Acting Judge to serve for such period of
temporary absence or inability to serve. Provided that the
Mayor, if he shall so serve, or such Acting Judge if so
appointed, shall duly take the oath of Recorder or Judge of
the Municipal Court.
SECTION 5. The Judge of the Municipal Court shall be a
qualified elector and actual resident of the City of The
Colony, Texas.
SECTION 6. This Ordinance is Declared to be for the
General Welfare.
The effective date of this Ordinance shall be, and this
Ordinance is Now PASSED and APPROVED, on this the 9 day
of January, A.D. 1978.
