ORDINANCE NO. 32
AN ORDINANCE OF CITY OF THE COLONY, TEXAS, FIXING THE 12TH
DAY OF AUGUST, 1978, AS THE DATE FOR HOLDING A SPECIAL ELECTION FOR
THE PURPOSE OF DETERMINING WHETHER OR NOT A HOME RULE CHARTER
COMMISSION SHALL BE CHOSEN TO FRAME A HOME RULE CHARTER FOR THE
CITY, AND FOR THE PURPOSE OF ELECTING FIFTEEN (15) COMMISSIONERS TO
SERVE AS MEMBERS OF THE CHARTER COMMISSION IN THE EVENT A MAJORITY
OF THE QUALIFIED VOTERS SHALL VOTE IN THE AFFIRMATIVE ON THE OUESTION
OF WHETHER A COMMISSION SHOULD BE CHOSEN; FIXING THE PROPOSITION TO
BE SUBMITTED; DESIGNATING THE POLLING PLACE AND THE HOURS OF VOTING;
PROVIDING FOR ELECTION OFFICIALS; AND ESTABLISHING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF CITY OF THE COLONY,
TEXAS:
SECTION 1.. That in accordance with the provisions of Articles 1165-1174,
Vernon's Annotated Civil Statutes of the State of Texas, an election is hereby called
to be held in the City on the 12th day of August, 1978, for the purpose of submitting
to the qualified voters of the City the question of whether or not a Commission shall
be chosen to frame a Home Rule Charter for the City.
SECTION 2. The proposition to be submitted to the voters shall be as
f ollows:
"Shall a Commission be chosen to frame a new charter"?
Answer: Yes No
SECTION 3. There shall also be elected at said election fifteen (1.5)
Commissioners to serve as members of the Charter Commission in the event a majority
of the qualified voters, voting on said question shall have voted in the affirmative.
Prospective candidates wishing to have their names placed on the official ballot for
such office shall file with the City Secretary their written application prior to 5:00
o'clock p.m. on July 25, 1978. The fifteen (15) candidates receiving the highest number
of votes cast for said office shall be elected to serve on said Commission.
SECTION 4. The polling place for said election shall be
The Colony Fire Station located at Blair Oaks and Colony Boulevard
SECTION 5. The polls shall be open from 7:00 o'clock a.m, to 7:00 o'clock
p.m.
None but legally qualified voters of the City shall be entitled to vote at
said election.
Notice of said election shall be given by posting a copy of this ordinance
in three (3) public places within the limits of the City at least thirty (30) days prior
to the election date and a copy of this ordinance shall be published in the offficial
newspaper of the City at least thirty (30) days prior to the date of said election.
A Presiding Election Judge and an Alternate Presiding Election Judge to
serve at such polling place, shall be appointed by written order of the Mayor, approved
and signed by at least a majority of the members of the governing body of the City.
The Presiding Judge for such polling place shall appoint two (2) Election Clerks to
serve at such polling place. All Judges and Clerks shall be qualified voters of the
City.
Absentee voting for the above designated election shall be held in the
regular office of the City Secretary at the City Hall Building, in said City, and said
place of absentee voting shall remain open for at least eight (8) hours on each day
of absentee voting which is not a Saturday, Sunday or an official state holiday, beginning
on the 20th and continuing through the 4th day preceding the date of said election.
Said place of voting shall remain open between the hours of 8 o'clock a.m. and
_o'clock p.m.
After holding said election, the Election Judges shall promptly make their
returns to the City Secretary and to the Mayor, and the Secretary shall thereafter
present such returns to the City Council for canvassing of said election. The Presiding
Election Judge shall be paid the sum of $ 2.50 per hour, plus an additional sum
Of $ 5.00 for his services in delivering the returns of the election. The Alternate
Presiding Election Judge shall be paid the sum of $ 2.50 per hour and each
Election Clerk shall be paid the sum of $ 2.50 per hour for their services in
holding the election. Such payments shall not exceed the maximum amounts set out
in Article 3.08, Texas Election Code.
SECTION 6. This ordinance shall take effect immediately from and after
its passage as the law in such cases provides.
DULY PASSED by the City Council of City of The Colony, Texas, on the

WHEREAS, on the lq day of Q*- Test 6" , 1978, an ordinance
was passed calling an election to be held on August 12, 1978, for the purpose of
determining whether or not a Home Rule Charter Commission shall be chosen to frame
a charter for the City.
NOW, THEREFORE, IT IS HEREBY ORDERED that Rose
Ashman is appointed Presiding Election Judge and Glenda Davis
election.
