HomeMy WebLinkAboutOrdinance No. 51ORDINANCE NO. 51 AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, FIXING THE TWENTIETH (20th) DAY OF JANUARY, 1979, AS THE DATE FOR THE HOLDING OF A SPECIAL ELECTION FOR THE PURPOSE OF DETERMINING WHETHER OR NOT A PROPOSED HOME RULE CHARTER WILL BE ADOPTED BY THE QUALIFIED ELECTORS OF THE CITY OF THE COLONY, TEXAS; FIXING THE PROPOSITION TO BE SUBMITTED; DESIGNATING THE POLLING PLACE AND THE HOURS FOR VOTING; APPOINTING THE ELECTION OFFICIALS AND PROVIDING FOR THEIR COMPENSATION; PROVIDING FOR ABSENTEE VOTING; AND MAKING THIS ORDI- NANCE THE NOTICE OF SUCH SPECIAL ELECTION. WHEREAS, the Charter Commission elected by the electors of the City of the Colony, Texas, on the twelfth (12th) day of August, 1978, have submitted to the City Council of the City of the Colony a proposed Home Rule Charter in accordance with their duties, and WHEREAS, the City Council is required under the provisions of Chapter 13, Title 28, of the Revised Civil Statutes of Texas, to submit the charter so framed by said Commission to the qualified voters of the City,an election to be held at a time fixed by the Charter Commission not less than forty (40)nor more than ninety (90) days after the completion of the work of the Charter Com- mission, and WHEREAS, the City Council desires to call such election as required and on a date permitted by the Texas Election Code, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That in accordance with the provisions of Article 1167, Vernon's Revised Civil Stattutes of the State of Texas, an election is hereby called to be held in the City of the Colony, Texas, on the twentieth (20th) day of January, 1979, for the purpose of submitting to the qualified voters of the City the question of whether or not the proposed Home Rule Charter so framed by the Home Rule Charter Com- mission shall be adopted for the City of the Colony, Texas. SECTION 2. It being impracticable to submit each section of the proposed charter, the entire charter shall be voted on as a whole. The prop- osition to be submitted to the voters shall be "FOR THE ADOPTION OF THE CHARTER" or " AGAINST THE ADOPTION OF THE CHARTER". SECTION 3. The polling place shall be the Camey Elementary School in the City of the Colony, Texas, and the polls shall be open from 7:00 a.m. to 7:00 p.m. on January 20, 1979. SECTION 4. That Rose Ashman is hereby appointed Presiding Election Judge and Glenda Jackson is hereby appointed alter- nate Presiding Judge to conduct said election. The Presiding Judge shall appoint no more than 10 clerks to assist him in holding said election. The election officials shall be paid in an amount not to exceed $ 2.50 per hour, and the Presiding Election Judge shall be paid in addition $ 5.00 for delivering the results of the election to the City Secretary as provided by law. SECTION 5. That the date set herein for the election is not less than forty (40) nor more than ninety (90) days after the completion of the work of said Charter Commission. That not less than thirty (30) days prior to January 20, 1979, the City Secretary shall mail a copy of the proposed Home Rule Charter to each qualified voter in the City as appears from the Tax Collector's rolls for the year ending January 31, 1978, all in accordance with the provisions of Article 1167 of Vernon's Revised Civil Statutes of the State of Texas. SECTION 6. That said election for the adoption of the Home Rule Charter shall in all respects be held in accordance with the requirements of the Election Code of the State of Texas, except as otherwise provided by Chapter 13 of Title 28 of Vernon's Revised Civil Statutes. SECTION 7. None but legally qualified voters of the City of the Colony, Texas, shall be entitled to vote at said election. SECTION 8. Notice of such election shall be given by publication of this Ordinance in full one (1) time in the official newspaper of the City of the Colony not less than ten (10) nor more than twenty- five (25) days before said election date. The City Secretary shall secure an affidavit from the publisher of the official newspaper of the City showing the exact publication and date thereof of this Ordinance. SECTION 9. The period for absentee voting by personal appearance shall begin on the second (2nd) day of January, 1.979, and shall. continue through the sixteenth (16th) day of January, 1979. Ab- sentee voting by other than personal appearance shall be conducted as provided by the Texas Election Code. SECTION 10. This Ordinance shall take effect immediately from and after its passage as the law in such cases provides. DULY PASSED BY THE CITY COUN IL OF THE CITY OF THE COLONY, 9 TEXAS, on the day of IV 1978.
