HomeMy WebLinkAboutOrdinance No. 11ZLOrdinance No. rr AN ORDINANCE PROVIDING FOR FILLING THE OFFICE OF SECRETARY OF THE CITY OF THE COLONY BY APPOINTMENT AS AUTHORIZED BY LAW WHEREAS, Article 977, Vernon's Annotated Texas Statutes as enacted and passed by the Regular Session of the 51st Texas Legislature, 1949, authorizes the City Council of Cities operating under the general laws to provide for the filling of the office of Secretary by Appointment, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That hereafter the office of Secretary of the City of The Colony shall be filled by appointment by the City Council. The official title of such person shall be "Secretary of the City of The Colony, Texas." SECTION 2. The Secretary of the City of The Colony shall have the powers and perform the duties as prescribed by the Laws of the State of Texas, Article 1000, Vernon's Annotated Texas Statutes, and by the Ordinances of the City of The Colony, Texas. SECTION 3. Said Secretary shall be appointed for a term of office running concurrently with that of the Mayor. The Secre- tary shall receive such compensation as the City Council may fix by Ordinance or Resolution, and shall furnish such surety bond as may be required by the City Council, the premium to be paid by the City. The Secretary shall take the Oath required by Law. SECTION 4. In the event of temporary absence or inability to serve of such Secretary, the Mayor of the City of The Colony, Texas, may so serve; or, the Mayor may appoint a suitable and qualified person as Acting Secretary to serve for such period of temporary absence or inability to serve. Provided, that the Mayor, if he shall so serve, or such Acting Secretary if so appointed, shall duly take the oath of Secretary of the City of The Colony, Texas. SECTION 5. The Secretary of the City of The Colony, Texas shall be a qualified elector and actual resident of the City of The Colony, Texas. SECTION 6. This Ordinance is Declared to be for the General Welfare. SECTION 7. WHEREAS, an emergency is apparent for the immedi- ate protection of the Public Welfare, there exists a necessity that this Ordinance become effective at once so that same shall become effective from and after the date of its passage and approval; accordingly, the effective date of this Ordinance shall be, and this 0 din ilce is Now PASSED and APPROVED, on this the 'zz day of A.D. 1977.
