HomeMy WebLinkAboutOrdinance No. 14STATE OF TEXAS ) COUNTY OF DENT ON ) CITY OF THE COLONY ) On this the lst day of August, 1977, the City Council of the City of The Colony, Texas convened in Regular Session, with the following members present, to -wit: Linda Adams- Mayor -pro tem Joe Gaulden Alderman Sandra Shearer Alderman Dick Weaver Alderman with the following absent: Luis M. Guerrero, Mayor; Dave Dall, Alderman, constituting a quorum, at which time the following proceedings were had: Mayor -pro tem;Linda Adams introduced for consideration of the City Council an ordinance. The ordinance was read in full by Linda Adams, Mayor -pro tem. Alderman Sandra Shearer made a motion that the ordinance: - be passed. The motion was seconded by Alderman Weaver. The motion was carried by the following vote: Ayes: Joe Gaulden, Alderman; Sandra Shearer, Alderman; and Dick Weaver, Alderman. Noes: None The ordinance is passed as follows: ( Continued on next page. ) ORDINANCE Dal , AN ORDINANCE AUTHORIZING THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS ACTING FOR AND ON BEHALF OF SAID CITY TO ENTER INTO ALL NECESSARY AGREEMENTS WITH THE EMPLOYEES RETIREMENT SYSTEM OF TEXAS RELATIVE TO FEDERAL OLD AGE, SURVIVORS, DIS- ABILITY AND HEALTH INSURANCE BENEFITS UNDER THE PROVISIONS OF APPLICABLE STATE AND FEDERAL LAWS: AUTHORIZING THE MAYOR TO EXECUTE ALL SAID NECESSARY AGREEMENTS AND INSTRUMENTS FOR AND ON BEHALF OF SAID CITY COUNCIL AND CITY: DIRECTING THE CITY TREASURER TO MAKE ASSESSMENTS, COLLECTIONS, AND REPORTS, AND ORDERING THE ALLOCATIONS AND SETTING ASIDE OF SUFFICIENT MONEY FROM AVAILABLE FUNDS TO CARRY OUT THE PROVISIONS OF SAID LAWS, SUCH MONEY TO BE SET ASIDE AND MAINTAINED IN THE REGULAR CITY DEPOSITORY AND TO BE KNOWN AS THE CITY OF THE COLONY SOCIAL SECURITY FUND. WHEREAS, under the provisions of (1) House Bill 603, Acts 52nd Legislature, R.S. 1951, as amended (article 6958, Vernon's Texas Civil Statutes) : and (2) P.L. 734, 81st Congress, Ch. 809, 2d, H.R. 6000 incorporated cities of this state may enter into agreements with The Employees Retirement System of Texas and secure the benefits of Federal Old Age, survivors, disability and health insurance, as outlined in said laws; and WHEREAS, it is the opinion of this City Council that the extension of this old age, survivors, disability and health insurance system will be of great benefit not only to the employees of the municipality by attracting to it and enabling it to retain the best of personnel and, thus, increase the efficiency of its government; and it is deemed that the payment by the municipality of its portion of the cost of said system is a payment for municipal purposes; and WHEREAS, it is the desire of this City Council to authorize the making of any and all necessary agreements in order to secure the benefits of said acts; therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: 1. That the City Council acting for and on behalf of the City of The Colony, Texas shall enter into all necessary agreements with the Employees Retirement System of Texas for the Purpose of carrying out the provisions of the above mentioned acts. 2. That Honorable Luis M. Guerrero, Mayor, is hereby appointed as Agent of the City Council and of The City to execute all necessary agreements and instruments for and on behalf of said City Council and City. 3. That the City Treasurer is hereby directed to be the person responsible for making assessments, collections, payments, and reports, as required by The Employers Retirement System of Texas. 4. That a sufficient sum of money be allocated and set aside from available funds for the purpose of carrying out the provisions of the above mentioned acts, such money so allocated and set aside to be known as the City of The Colony, Texas Social Security Fund, which fund shall be set aside and maintained in the regular city depository. 5. This Ordinance is Declared to be for the General Welfare. PASSED AND APPROVED at the City of The Colony, at a Regular Meeting of the City Council, on this_2!�E_day of u'-"; / r , A.D. 1977.
