HomeMy WebLinkAboutOrdinance No. 97-979 - ORIGINAL CITY OF THE COLONY, TEXAS ORDINANCE NUMBER ~/-q ?c~ AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING THE CITY'S COMPREHENSIVE MASTER PLAN ADOPTED BY RESOLUTION NUMBER 78-02 AND AMENDED BY RESOLUTION NUMBER 84-02 IN ITS ENTIRETY BY ADOPTING THE COMPREHENSIVE PLAN ATTACI-1FD HFR.ETO; DETERMINING THAT IT IS IN THE PUBLIC INTEREST, HEALTH, SAFETY AND GENERAL WELFARE TO ADOPT THE SAID COMPREHENSIVE PLAN; REPEALING ANY ORDINANCE IN CONFLICT WITH THIS ORDINANCE, PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE. Wlt~REAS, the City of The Colony, Texas (the "City) heretofore, by the adoption of Resolution No. 78-02, adopted a comprehensive master plan for the entire City and amended by Resolution No. 84-02, which Comprehemive Master Plan included, among other things, general direction concerning land use, transportation, and public facilities; and WFFF~REAS, the City Council is authorized and empowered to amend the Comprehensive Master Plan pursuant to Section 211,004Co), Tex. Loc. Gov. Code; and WHEREAS, since the adoption and amendment of the Comprehensive Master Plan numerous change have occurred within and without the City relating to, among other things, land use, transportation, parks and recreation, public facilities and infrastructure; and WFI'EREAS, the said changes prompted review of the Comprehensive Master Plan by the City, which review included numerous studies, meetings of the Planning and Zoning Commission and City Council; and WltEREAS, after public notice was given and public hearing was conducted, and al~er considering the information submitted at the said public hearing and all other relevant information and materials, the Planning and Zoning Commission of the City has recommended to the City Council the adoption of the amendments to the Comprehensive Master Plan for the City; and WHEREAS, after due deliberations and consideration of the recommendation of the Planning and Zoning Commission and the information and other materials received at the public hearing, the City Council has concluded that the adoption of this Ordinance is in the best interests of the City of The Colony, Texas and of the public health, safety and welfare. NOW, Tm~REFORE, BE IT ORDAINED BY TFFE CITY COUNCIL OF '[HE CITY OF TItE COLONY, TEXAS: Section 1. Incorporation of premises. The above and foregoing premises are true and correct and are incorporated herein and made part hereof for all purposes. Section 2. Adoption of Comprehensive Plan. The Comprehensive Master Plan for the City of The Colony, Texas as adopted by Resolution No. 78-02 and amended by Resolution No. 84- 02 is hereby amended by adopting the Comprehensive Plan of 1997, a true and correct copy of which is attached hereto and incorporated herein. The said Comprehensive Plan 1997, as the same may be amended from time to time, shall hereai~er serve as the sole comprehensive plan for the City. Section 3. Savings. This Ordinance shall be cumulative of all other ordinances of the City affecting the City's land use planning and shall not repeal any of the provisions of those ordinances except in those instances where the provisions of those Ordinances are in direct conflict with the provisions of this Ordinance. Section 4. Severability. The sections, paragraphs, sentences, phrases, clauses and words of this Ordinance are severable, and if any section, paragraph, sentence, phrase, clause or word in this Ordinance or application thereof to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance, and the City Council hereby declares that it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 5. ~. This Ordinance shall become effective from and aRer its date of passage as provided by law.
