AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, AMENDING CHAPTER 4 AMUSEMENTS OF ~ CODE OF ORDINANCES BY THE ADDITION OF ARTICLE V REQUIRING PERMITS FOR SPECIAL EVENTS; PROVIDING FOR A PENALTY OF A FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) AND THAT EACH DAY SAID VIOLATION CONTINUES SHALL CONSTITUTE A SEPARATE OFFENSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section I. That Chapter 4 Amusements of tile Code of Ordinances of the City of Tile Colony is lgreby amended by the addition of Article V, which shall read h~ its entity as follows: ARTICLE V. SPECIAL EVENTS ~ 4-90. Dd~niflons. Spee/~/Eremt:. Special event shell mean an event to be held within the City of The Colony that ia of limited duration and is likely to attract viaitor~. Examples of special events im~ud~ (without limitation) exhibitions, automobile races, sporting events, festivals, air shows, and religioua events. Special evonls are temporary activities that are almormal to the specie site wlmn m~ds of traffic, parking, r~trooms, noise level, crowds, zoning, etc. exct~d the original design and inter of the site. This article does not apply to tamporary activities occurring on property appropriately zoned to permit the activity. Sec. 4-91. Enfor~mont Officer. The Building Official shell have responsibility for the administration and enforcement of the provisions of this article and shell Ntabliah rules and regulations governing special events hem within rite City. A copy of tim rules ami r~gulafions sh~ll be kept in the City Secr~tsry's office .nd open For inspection at all times. Sec. 4-92. Permit Required. Special eveMs may lawfully tak~ place during the periods approved by the building off'~ial at the time application for permit is made by a Civic, School, Philanthropic, Church, or other non profit organization. Ail applications to conduct a special event shall be submitted to the Building Official on a form provided by the Bufldb~g Official. The Building Official, dieter review oF the application, shall make a determination as to whether or not the application shouJd be granted or refused. Any applicant who has been refused issuance of a permit under this section shall have the right of appeal to the City. Core, cji. The City Council's decision regarding an appeal shall be final. Sec. 4-93. Outside Sales. All temporary outside sales sJmll be conrhcted in accordance with the rule~ and rt~dafions e~lablJshed by the building official in Sec. 15-12. Section 2. This ordinmrce shall be cumulative of all other ordinmlces of the City and shall not repeal any of the provisions of those ordinances except in those instances where the provisions of those ordinances are in direct conflict with the provisions of this ordinance. ,Section 3. Any person, finn, corporation, agent or employee thereof who violates any of the pwvisions of this ordinance shall be deemed guilty of a misdemeanor and upon corrviction hereof shall be freed a polity of a sum not to exceed Two Thousand Dollars ($2,000.00) t'or each offense and a separate offe~tse shall be deemed committed on each day during or on which a violation occurs, Section 4. If tory section or provision of this ordinance or tile application of that section or provision to m~y person, firm, corporation, situation or circumstance is for m~y reason judged invalid, tile adjudication shall not affect any other section or provision of this ordinance or the application of any other sectiou or provision to any other person, firm, corporation, situation or circumstance, and the City Council declares that it would have adopted tile valid portions and applications of the ordinance without the i~lvalid parts and to this end the provisions of this ordinance shall remain in full force and effect. Section 5. That this ordinance shall take effect immediately from and afar its passage arid approval, and it is so ordained.
