ORDINANCE NO. 97-994
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, AMENDING CHAPTER 12 - MUNICIPAL UTILITIES
AND SERVICES, OF THE CODE OF ORDINANCES BY AMENDING
SECTION 12-20 DEFINITIONS; SECTION 12-22 LEGAL DISPOSAL
ONLY; SECTION 12-24 RESIDENCE COLLECTION PROCEDURE
GENERALLY; SECTION 12-26 LOCATION OF CONTAINERS AND
SECTION 12-27 FEES AS SET; PROVIDING FOR A PENALTY OF A FINE
NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00);
PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN E~'~'I~CTIVE
DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS:
Section 1. That Section 12 - Municipal Utilities and Services of the Code of
Ordinances of the City of The Colony shall be amended as follows:
Sec. 10-20. Definitions.
Bags. A minimum of two (2) mil in thickness plastic sacks designed to store
refuse with sufficient wall strength to maintain physical integrity when lifted by the top. In
no event shall the total weight of a hag and its contents exceed thirty (30) pounds.
Bulky items: Stoves, refrigerators, water tanks, washing machines, furniture
and other large waste materials, other than construction debris, dead animals, hazardous
wastes or stable matter with weights or volume greater than those allowed for containers.
Bundle: Tree, shrub and brush trimmings or newspapers and magazines
securely tied together forming an easily handled package not exceeding four (4)
feet in length or forty (40) pounds in weight.
Container: A plastic bag not to exceed thirty (30) gallons or thirty (30)
pounds; or a polycart.
Customer: An occupant of a residential, commercial or industrial unit who
generates refuse.
Polycart: A robber, wheeled container, having a minimum capacity of ninety
(90) to ninety-six (96) gallons, designed for semi-antomated or automated solid waste
collection systems. Construction shall be injected molded polyethylene.
Solid Waste: All matter included under the def'mitions of garbage, rubbish and
bulky items.
Residential Unit: ........... Apartment complexes shall use commercial bins.
Sec. 12-22. Legal disposal only.
All solid waste shall be disposed of by the methods hereinafter set forth. It
shall be unlawful and an offense to dispose of solid waste ...................... "
Sec. 12-24. Residence collection procedure generally.
(1) ................ Customers shall place solid waste for collection in the city's
right-of-way, ..........................
(2) Customers shall place all such waste out for collection by 7:00 a.m., on
their designated collection days, ....................... The city shall not be responsible for missed
collection service if the customer places waste out for collection after 7:00 a.m., on their
designated collection days or prior ...........................
(3) Customers shall use polycart containers for garbage ................................ All
putrescible matter must be inside the polycart container. The loaded weight of each
individual bag, or bundle shall not exceed thirty (30) pounds.
Sec. 12-26. Location of containers.
Containers shall not be stored at curbside. All containers shall be returned to a
sight immediately adjacent to the residence or inside a storage area at the residence within
twenty-four (24) hours after scheduled pick-up.
Sec. 12-27. Fees as set.
..................... a monthly billing charge, franchise fee to contractors, if any and
applicable sales taxes ................................ A residence shall be considered occupied if it is an
active municipal utility account receiving water .....................
Section 2. Savings.
This Ordinance shall be cumulative of all other ordinances of the city affecting
Murdcipal Utilities and Services and shall not repeal any of the provision of those ordinances
except in those instances where the provisions of those Ordinances are in direct conflict with
the provisions of this Ordinance.
Section 3. Penalty.
It shall be unlawful for any person to violate any provision of this Ordinance, and any
person violating or failing to comply with any provision hereof shall be freed, upon
conviction, in an amount not more than Five Hundred Dollars ($500.00) as set forth in the
City's Code of Ordinances, and a separate offense shall be deemed committed each day
during or on which a violation occurs or continues.
Section 5. Severability.
If any section, article, paragraph, sentence, clause, phrase or word in this ordinance or
application thereof to any person or circumstance is held invalid or unconstitutional by a court
of competent jurisdiction, such holding shall not affect the validity of the remaining portions
of this ordinance, and the City Council hereby declares it would have passed such remaining
portions of this ordinance despite such invalidity, which remaining portions shall remain in
full force and effect.
Section 6. Effective Date.
This Ordinance shall become effective from and after its date of passage and
publication of the caption hereof as provide~b), Law.
