ORDINANCE NO. ~48
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
AMENDING THE CODE OF ORDINANCES, CITY OF THE COLONY,
TEXAS BY AMENDING CHAPTER 12, BY AMENDING SECTION 6
RELATING TO RATES; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A PENALTY OF FINE NOT TO EXCEED ONE
THOUSAND DOIJ.ARS ($1,000.00) FOR EACH OFFENSE AND A
SEPARATE OFFENSE SI-IAI.IJ BE DEEMED COMMITrED EACH DAY
DURING OR ON WHICH A VIOLATION OCCURS; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
I. Chapter 12 of the Code of Ordinances shall be and is hereby amended in the
following particulars:
SECTION 6. RATES
1. Any person receiving water from the City shall be charged and pay for such
water according to the following rates:
(a) Single and Multiple Residential and Commercial
0-2000 gallons $10.00
(b) Commercial (with single meters and multiple 1jrdts
Base charge will be based on meter size as follows:
5/8" meter $10.00 flat base
3/4" meter $12.00 flat base
1" meter $20.00 flat base
1 1/2" meter $25.00 flat base
2" meter $30.00 flat base
2 1/2" meter $35.00 flat base
3" meter $40.00 flat base
3 1/2" meter $45.00 flat base
4" meter $50.00 flat base
Meter sizes not covered will have a flat base set by the City Manager.
2. Any person who violates Section 18.1 through 18.3 of this chapter shall be
guilty of a misdemeanor and shall be liable for a fine of not more than one thousand dollars
($1,000.00) per each violation thereof. The City shall also have power to enforce this
chapter through civil actions in the courts, as provided by State Law. Services may be
discontinued to any customer who violates Section 18.1 through 18.3.
3. If any section, article paragraph, sentence, clause, phrase or word in this
ordinance, or application thereto any persons or circumstances is held invalid or
unconstitutional by a Court of co ....
mpetent jurisdiction, such holding shall not affect the
validity of the remaining portions of this ordinance; and the City Council hereby declares
it would have passed such emmmng portions of this Ordinance despite such invalidity,
which remaining portions shall remain in full force and effect.
4. That this ordinance shall take effect immediately from and after its passage
and it is so ordained.
