AN ORDINANCE OF THE CITY OF THE COLONY AMENDING ITS
COMPREHENSIVE ZONING ORDINANCE, REPEALING ORDINANCE
NUMBER 95; ADOPTED ON FEBRUARY 18, 1980, IN ITS ENTIRETY, AND
ESTABLISHING SPECIFIC USE PERMIT NUMBER 2; PROVIDING FOR A
CHURCH UPON PROPERTY CURRENTLY ZONED FOR THE (SF) SINGLE
FAMILY RESIDENTIAL DISTRICT LOCATED AT THE SOUTHEAST
CORNER OF THE INTERSECTION OF BLAIR OAKS ROAD AND CLOVER
VALLEY DRIVE AND MORE SPECIFICALLY AT 5220 BLAlR OAKS ROAD,
AMENDING THE OFFICIAL ZONING MAP; AND PROVIDING FOR A
PENALTY, SAVINGS, SEVERABILITY, AND AN EFFECTIVE DATE.
WHEREAS, at its regular meeting held on the 13th day of February, 1996, the Planning and Zoning
Comnfission did consider and make recommendations on a certain request for a Special Use Permit
(Case No. 02-96SUP1).
WHEREAS, the City Council, after determining all legal requirements of notice and hearing have
been met, has further determined the following amendment to the zoning laws would provide for and
would be in the best interest of the health, safety, morais, and generai welfare:
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
Section 1.
That Ordinance Number 95, adopted on February 18, 1980 is hereby repeaied in its entirety.
Section 2.
That Special Use Permit 2 is hereby established for a certain 4.738 acre lot located at the southeast
comer of the intersection of Blair Oaks Road and Clover Valley Drive, situated in Lot 1, Block 1
of the Calvary Temple Addition and more specifically described on the attached Exhibit A, providing
for the following use:

Section 3.
That development shall be in conformance with the Site Plan, attached hereto as Exhibits B
Section 4.
That the Official Zoning Map is hereby amended to reflect the action taken herein.
Section 5.
Penalty Clause
That any person, firm or corporation violating a provision of this ordinance, upon conviction, is guilty
of a misdemeanor and shall be subject to a fine in a sum not to exceed Two Thousand Dollars
($2,000.00) for each offense and a separate offense shall be deemed committed upon each day during
or on which a violation occurs or continues.
Section 6.
Severability Clause
That the provisions of this ordinance, if held invalid or unconstitutional by a Court of competent
jurisdiction, shall not affect the validity of the remaining portions of this ordinance; and the City
Council hereby declares it would have passed such remaining portions of the ordinance despite such
invalidity, which remaining portions shall remain in full force and effect.
Section 7.
Savings Clause
That Ortlinance Number 61, otherwise known as the Comprehensive Zoning Ordinance, as amended,
shall remain in full force and effect.
Section 8.
That this ordinance shall become and be effective on and after its adoption.

Legal Description
A tract o£1and situated in the B.B.B. & C R.R. Survey, Abstract No. 173 and also being all of a 4.737
acre tract as recorded in Volume 2582, Page 578 of the Deed Records o£Denton County, Texas and
being more particularly described by metes and bounds as £ollows:
BEGINNING at the 1/2 inch iron rod found £or comer at the intersection o£the east right-o£-
way line o£Blair Oaks Road and the north line o£a 15' alley along the north line o£ Block 15, The
Colony No. 3 as recorded in Volume 11, Page 22 o£the Plat Records of Denton County, Texas;
THENCE North 00 degrees 08 minutes 46 seconds West following the east right-of-way line o£
said Blair Oaks Road a distance 0£245.60 £eet to a "X" cut £ound for comer;
THENCE North 89 degrees 50 minutes 58 seconds East a distance o£841.00 feet to a 1/2 inch
iron rod set £or corner;
THENCE South 00 degrees 14 minutes 30 seconds East a distance of 245.10 feet to an 1/2 inch
iron rod set for comer;
THENCE South 89 degrees 48 minutes 55 seconds West a distance o£841 A0 feet to the POINT
OF BEGINNING and containing 206,390 square £eet or 4.738 acres of land
