HomeMy WebLinkAboutOrdinance No. 935 ORIGINAL ORIGINAL CITY OF THE COLONY, TEXAS ORDINANCE NO. 93~ AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF THE COLONY, TEXAS, ORDINANCE NO. 61, AS AMENDED, PASSED AND APPROVED ON JUNE 4, 1979, THE SAME BEING APPENDIX A OF THE CODE OF ORDINANCES OF THE CITY OF THE COLONY, TEXAS, BY AMENDING SECTION 24- 101 OF APPENDIX A-ZONING; REQUIRING APPLICANTS TO POST ZONING NOTIFICATION SIGNS ON SUBJECT PROPERTY, ESTABLISH A MINIMUM SIGN DEPOSIT REQUIREMENT; ESTABLISH A PENALTY FOR NON-COMPLIANCE; AND PROVIDE AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That the Section 24-101 of the Comprehensive Zoning Ordinance of the City of the Colony, Texas is hereby amended by adding the following: Sec. 24-101 Procedure. (7) Upon filing an application for an amendment or change in classification and/or boundary of a zoning district, notification sign(s) will be erected on said property. The following conditions pertain to the erection of said sign(s): (a) The applicant shall erect one (1) sign for each four hundred (400) fee of street frontage of the property, with a minimum of tow (2) signs on each street frontage, except that no applicant is required to erect more than fifteen (15) signs. If the property does not have street frontage, the signs shall be placed upon the closest available right-of-way and upon the property itself. the applicant shall erect the signs not less than ten (10) days prior to the scheduled public hearing before the Planning and Zoning Commission and the signs shall be kept in place until final action has been taken by the City Council concerning the application. (b) Said sign(s) will be provided by the Planning Department to the applicant at the time of application submittal. A fifty dollar ($50.00) security deposit is required at the time of application. The deposit shall be refunded to the applicant if the signs are returned to the Planning Department no later than Zoning Signs Required Page 1 of 2 than five (5) working days after final action has been taken by the City Council. (c) The Planning and Zoning Commission shall make a determination, based upon evidence presented at the public hearing, as to whether the intent of this ordinance has been met and the applicant has made a good faith effort to erect and maintain the sign(s). In the event the applicant fails to erect and maintain said sign(s) in accordance with the provisions of this ordinance, the public hearing before the Planning and Zoning Commission may be postponed to a future date so as to allow time for compliance. Section 2. That this ordinance shall take effect immediately from and after its passage and it is so ordained.
