ORDINANCE NO.
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
DISANNEXING A CERTAIN 7.684 ACRE TRACT OF LAND AS MORE
SPECIFICALLY DESCRIBED HEREIN; PROVIDING FOR RELEASE OF
EXTRATERRITORIAL JURISDICTION; PROVIDING FOR CERTAIN
CONDITIONS; PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, the landowner of a certain 7.684 acre tract of land located with the
corporate limits of the City of The Colony, Texas and a 24.459 acre tract of land located
with the corporate limits of the City of The Colony, Texas, has requested that the two cities
exchange the said tracts of land, so that the 24.459 acre tract of land will become part of
the City of The Colony and the 7.684 acre tract of land will become part of the City of
Lewisville; and
WHEREAS, the request of the landowner has been reviewed by the City Council of
the City of The Colony and the City Council of the City of Lewisville; and
WHEREAS, both Councils deem the public interest to be best served by the exchange
of the said tracts of land; and
WHEREAS, the 24.459 acre tract is contiguous to the city limits of the City of The
Colony; and the 7.684 acre tract is contiguous to the city limits of the City of Lewisville; and
WHEREAS, notice of the impending exchange between the two (2) cities has been
given to the affected landowner(s).
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS:
Section 1. That the above recitals are hereby found to be true and correct and
incorporated herein for all purposes.
Section 2. That the City Council of the City of The Colony hereby disannexes, as
a part of the City of The Colony for any purpose whatsoever, a certain 7.684 acre tract of
land more specifically described by the hereto attached Exhibit "A".
Section 3. The City of The Colony hereby relinquishes any and all extraterritorial
jurisdiction which it has or may have, under the provisions of Chapter 42 of the Texas Local
Government Code, and upon adoption of this ordinance the City of The Colony shall no
longer have or exercise any right, jurisdiction or control over the above described tract of
land.
Section 4. This Ordinance is conditioned upon the City of Lewisville initiating
proper annexation procedures over the said 7.684 acre tract of land, as described in Exhibit
"A" and, if for any reason, the City of Lewisville does not initiate annexation proceedings
within sixty (60) days from the date of this Ordinance, this Ordinance shall be of no force
and effect, and the said tract of land shall remain as part of the City of The Colony.
Section 5. If any section or provision of this ordinance or the application of that
section or provision to any person, fir m, corporation, situation or circumstance is for any
reason judged invalid, the adjudication shall not affect any other section or provision of this
ordinance or the application of any other section or provision to any other person, firm,
corporation, situation or circumstance, and the City Council declares that it would have
adopted valid portions and applications of this ordinance without the invalid parts and to
this end the provision~c~this ordinance shall remain in full force and effect.
