ORDINANCE NO. t~¢~
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, AMENDING CHAPTER 6, ARTICLE VI,
CONSTRUCTION OF PUBLIC WORKS, OF THE CODE OF
ORDINANCES; PROVIDING FOR A FINE NOT TO EXCEED THE SUM
OF TWO THOUSAND DOLLARS ($2,000); PROVIDING A SEVERABILITY
CLAUSE; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
Section 1. That Chapter 6, Article VI Construction of Public Works, of the Code
of Ordinances of the City of The Colony, shall be amended by the addition of the following
subsection, which shall read in its entirety as follows:
"Sec. 6-132(a). Public Works Inspection Fees
(1) For the development of any subdivision, the developer shall pay
an inspection fee of one percent (1%) of the total contract
amount of the work involving the installation or improvement
of any of the following items intended for dedication to the
City, located on City-owned property, and/or within a public
easement:
Streets, alley ways, water, sewer, drainage or storm sewer
systems, sidewalks, screening and/or retaining wails, and/or
fences.
Fifty percent ($0%) of this fee must be paid at the time of the
preconstruction meeting; the remaining fifty percent ($0%)
must be paid prior to final acceptance of the subdivision by the
City.
(2) An additional fee of $40.00 per hour, with a two (2) hour
minimum, shall be assessed for any inspections scheduled after
regular City business hours (Monday through Friday from 8:00
a.m. to $:00 p.m.), or on holidays.
After-hour and holiday inspection requests must be scheduled
at leas4; twenty-four (24) hours in advance, and the fee paid at
the time of the inspection request."
Section 2. Any person violating the provision of this Ordinance shall be deemed
guilty of a misdemeanor and upon conviction be subject to a fine in accordance with the
general provisions of the Code of Ordinances.
Section 3. If any section or provision of this ordinance or the application of that
section or provision to any person, firm, corporation, situation or circumstance is for any
reason judged invalid, the adjudication shall not affect any other section or provision of this
ordinance or the application of any other section or provision to any other person, firm,
corporation, situation or circumstance, and the City Council declares that it would have
adopted the valid portions and applications of the ordinance without the invalid parts and
to this end the provisions of this ordinance shall remain in full force and effect.
Section 4. That this ordinance shall take effect immediately from and after its
passage and it is so ordained.
