ORDINANCE NUMBER ~
AN ORDINANCE OF THE CITY OF THE COLONY AMENDING ITS
COMPREHENSIVE ZONING ORDINANCE AND REPEALING PLANNED
DEVELOPMENT NUMBER 8 AS ESTABLISHED BY ORDINANCE
NUMBER 850 ON JUNE 20, 1994; AND CREATING A NEW PLANNED
DEVELOPMENT NUMBER 8; PROVIDING FOR AN ADDITIONAL FORTY
(40) ACRES OF LAND FOR SINGLE FAMILY RESIDENTIAL USES UPON
PROPERTY LOCATED WEST OF F.M. 423, ON BOTH NORTH AND SOUTH
SIDES OF N. COLONY BOULEVARD; AMENDING THE OFFICIAL ZONING
MAP; AND PROVIDING FOR A PENALTY, SAVINGS, SEVERABILITY
AND AN EFFECTIVE DATE.
WHEREAS, at its regular meeting held on the 19th day of December, 1996, the Planning and
Zoning Commission did consider and make recommendations on a certain request for a Planned
Development District (Case No. 11-96ZI).
WHEREAS, this change of zoning is in accordance with the adopted Comprehensive Plan of the
City of The Colony, as amended;
WHEREAS, the City Council, after determining all legal requirements of notice and hearing have
been met, has further deternfined the following amendment to the zoning laws would provide for
and would be in the best interest of the health, safety, morals, and general welfare:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS:
Section 1.
That Planned Development Nun£oc~- S as ratified bv Ordinance Number 850 on June 20, 1994 is
hereby repealed in its entirety.
Section 2.
That a new Planned Development Number 8 is hereby established for a certain 233.206 acre tract
of land located west of F.M. 423, on the north and south sides of N. Colony Boulevard, situated
in the Patrick O'Leary Survey, Abstract No.s 244 and 978, the B.B.B. & C.R.R. Survey,
Abstract No. 181, and the R.G. Dunlap Survey, Abstract No. 352, Denton County, Texas, and
more specifically described on the attached Exhibit A, providing for the following uses and that
development shall be in accordance with the following special conditions, restrictions, and
regulations:

TRACT A - Parcel I (24.558 acres)
Permitted
The permitted uses shall comply with those uses identified for the Single Family Districts in the City
of The Colony Code Book.
Nineteen hundred (I ,900) square foot minimum for the main building exclusive of breezeways,
garages, patios, accessory spaces or attached accessory buildings not used for dwelling purposes.
Two (2) stories with a maximum height of thirty-five (35) feet.
Area Regulations
Typical Lot Size: Sixty-five (65) foot width by one hundred and fifteen (115)
foot depth.
Minimum Lot Area: Seventy-four hundred (7,400) square feet.
Minimum Lot Width: Sixty-five (65) feet at the front building line.
Minimum Lot Depth: One hundred (100) feet where the front building line is on a
curve or a cul-de-sac.
Minimum Front Yard: Twenty-five (25) feet.
Minimum Side Yard: Six and one-half (6.5) feet except for comer lots which shall
have a minimum side yard often (10) feet.
Minimum Rear Yard: Twenty (20) feet except fbr from entry lots which shall have
a minimum rear setback often (10) feet.
Maximum Lot Coverage: Fifty percent (50%).
Garages: Two car garage capacity with rear or side entry, except for
lots impacted by the flowage easement or adjacent to open
space which shall have front or swing entry garages. No
more than 12% of the units shall have front entry.
Parking: Two (2) spaces for each dwelling unit.
Building Standard: All building standards shall comply with the City of The
Colony standards in place at the passage of this ordinance.

Permitted Uses
The permitted uses shall comply with those uses identified for the Single Family Districts in the City
of Thc Colony Code Book.

garages, patios, accessory spaces or attached accessory buildings not used for dwelling purposes.
Height
Two (2) stories with a maximum height of thirty-five (35) feet.
Area Regulations
Typical Lot Size: Eighty (80) foot width by one hundred and twenty (120) foot
depth.
Minimum Lot Area: Ninety-six hundred (9,600) square feet.
Minimum Lot Width: Eighty (80) feet at the front building line.
Minimum Lot Depth: One hundred (100) feet where the front building line is on a
curve or a cul-de-sac.
Minimum Front Yard: Twenty (20) feet.
Minimum Side Yard: Eight (8) feet except for comer lots which shall have a
minimum side yard of ten (10) feet. Lots abutting Lake
Lewisville may reduce the side yard to 6.5 feet if the total side
yard dimensions are sixteen (16) feet combined.
Minimum Rear Yard: Zero (0).
Maximum Lot Coverage: Fifty pement (50%).
Garages: Two car garage capacity with swing entry garages.
Parking: Two (2) spaces for each dwelling unit.
Building Standards: All building standards shall comply with the City of The
Colony standards in place at the passage of this ordinance.

Two (2) stories with a maximum height of thirty-five (35) feet.

Typical Lot Size: Fifty-five (55) foot width by one hundred and ten (110) foot
depth.
Minimum Lot Area: Six thousand (6,000) square feet.
Minimum Lot Width: Fifty-five (55) feet at the front building line.
Minimum Lot Depth: One hundred (100) feet where the front building line is on a
curve or a cul-de-sac.
Minimum Front Yard: Twenty (20) feet.
Minimum Side Yard: Five (5) feet except for comer lots adjacent to residential
streets which shall have a minimum side yard often (10) feet
or adjacent to a collector street which shall have a minimum

Permitted Uses
The permitted uses shall comply with those uses identified for the Single Family (Attached i District
· in the City of The Colon~ Code Book.
Dwelling Size
Fourteen hundred (1,400) square foot minimum for the main building exclusive of breezeways,
garages, patios, accessory spaces or accessory buildings not used for dwelling purposes. Should
patio homes be developed in this parcel the minimum dwelling unit will be fifteen hundred (1,500)
square feet.
Height
One (I) story at street level with additional floors downslope to a maximum of forty-five (45) feet
total.
Area Regulation~
Typical Lot Size: Twenty-five (25) foot width by one-hundred (100) foot depth.
If single family detached, forty (40) foot width by one-
hundred (100) foot depth.
Minimum Lot Area: Twenty-five hundred (2,500) square feet. If single family -
detached, four thousand (4,000) square feet.
Minimum Lot Width: Twenty-five (25) at front building line. If single family-
detached, forty (40) feet at the front building line.

a cul-de-sac.

AMENITIES
The following Stewart Peninsula Amenities shall meet all guidelines for Parks and open space and
shall be maintained and operated by the Homeowners Association.
SOUTHSHORE PARK (1.324 acres)
Southshore Park is a neighborhood park that will tie into the master trail system and Stewart Creek
Park.
NORTHSHORE PARK (0.50 acre, s)
Northshom Park is a neighborhood park that wilt tie into a master trail system.
RECREATION CENTER (3.837 acres)
The recreation center will provide multiple activities for the residents of Stewart Peninsula.
Depending on trends in the market and developer needs, this neighborhood center may move within
Parcel F and may include one or more of the following: a pool, cabana, multi-purpose court, play
equipment, open areas and parking. Acreage of the recreation center may vary based on those
elements chosen to be included.
DENSITY TRANSFER
The ability to transfer density throughout the duration of this project is inherent in the flexibility of
this Planned Development District. Flexibility is important as market conditions change, tracts are
adjusted at platting, and the open space areas are calculated.
A tract within this project may be developed in a less dense manner if the market shifts and a less
dense product is more desirable. The developer may then transfer this loss in density to another part
of the project and be compensated for the previous loss as long as the overall project density cap
remains the same. To achieve the density transfer, the minimum lot width in any Tract/Parcel may
be narrowed a maximum of 15% and the minimum side yard may be reduced to 10% of the new
minimum lot width. Under no circumstances shall the lot width be less than fifty (50') feet, except
for the Single Family (Attached) category. Those regulations approved for the Single Family
(Attached) category will not be used anywhere within the project except Tract C - Parcel 1.
At the tim~ oI'ptehminary plat submittal a usage table will be included on the plat which describes
the tract's land ~se, acreage, density, and cumulative total of the overall P.D. lot count relative to the
allowable overall P.D. lot count which relates to the densk7 cap.
The total number of dwelling units for the entire Planned Development shall not exceed a 848
~ based on the gross acreage of the entire tract or 848 dwelling units + 233.206 acres
= 2a~32~.~Xp~lg~l~ per acre for the entire project.
Should additional tracts of land adjacent to the property be added to this Planned Development,
thereby increasing the overall gross acreage and the overall total dwelling unit cap, it will be
processed through the standard City of The Colony zoning process.

. Section 6.
Severability Clause
That the provisions of this ordinance, if held invalid or unconstitutional by a Court of competent
jurisdiction, shall not affect the validity of the remaining portions of this ordinance; and the City
Council hereby declares it would have passed such remaining portions of the ordinance despite
such invalidity, which remaining portions shall remain in full force and effect.
Section 7.
Savings Clause
That Ordinance Number 61, otherwise known as the Comprehensive Zoning Ordinance, as
amended, shall remain in full force and effect.
Section 8.
That this ordinance shall become and be effective on and after its adoption.
