That the City Manager of the City of The Colony, Texas is hereby authorized to execute on behalf of the City a contract with (�LAss+ M 10o2.SPEciAAAsTfor the purchase of doors and windows for the city hall/library facility. The approved form of contract is attached hereto as Exhibit "A", and made a part hereof for such purposes. SECTION 2. This Ordinance shall take effect immediately from and after its passage by the City Council of the City of The Colony, Texas. Hicks, TRMC, City Secretary APPROVED AS TO FORM: City torney PROVED: Mary Bl it W s, Mayor CITY OF THE COLONY, TEXAS AGREEMENT This agreement is entered into by the City of The Colony, Texas, hereinafter referred to as the "City", and Glass and Mirror Specialists , hereinafter referred to as the "Contractor". A. Contractor hereby agrees to provide and install all windows, doors and hardware for the new City Hall/Library according to the specifications set out in Bid No. 85-99-15 DOORS and at a cost not to exceed $164,205.00. B. Contractor shall provide proof of insurance in accordance with V.A.C.S. requirements. C. Contractor agrees to defend, indemnify and hold harmless the city from all damages, costs, expenses, and attorney fees for all claims and suits including claims and suits for death, personal injury, and property damage, arising out of, or connected with, the work performed under this contract whether or not caused in whole or in part by the negligence of the city, its agents, or employees. D. All material is guaranteed to be as specified, and the above work is to be performed in accordance with the specifications submitted for above work and completed in a substantial workmanlike manner. E. Invoices are to be presented to the City of The Colony by the first (1st) of each month, and shall be paid in accordance with the financial procedures for the City of The Colony.
