ORDINANCE NO. 99-1092
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING THE
CODE OF ORDINANCES, CITY OF THE COLONY, TEXAS BY AMENDING
CHAPTER 12, BY AMENDING SECTION 6 RELATING TO RATES; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED
ONE THOUSAND DOLLARS ($1,000.00) FOR EACH OFFENSE AND A SEPARATE
OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH
A VIOLATION OCCURS; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS:
1. Chapter 12, Section 6 of the Code of Ordinances shall be and is hereby amended in the
following particulars:
"l. Any person receiving water and sewer from the City shall be charged and pay for such
water according to the rates as described in Exhibit "A" attached hereto".
2. Any person who violates Section 18.1 through 18.3 of this chapter shall be guilty of a
misdemeanor and shall be liable for a fine of not more than one thousand dollars ($1,000.00) per each
violation thereof. The City shall also have power to enforce this chapter through civil actions in the courts,
as provided by State Law. Services may be discontinued to any customer who violates Section 18.1 through
18.3.
3. If any section, article paragraph, sentence, clause, phrase or word in this ordinance, or
application thereto any persons or circumstances is held invalid or unconstitutional by a Court of competent
jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the
City Council hereby declares it would have passed such remaining portions of this Ordinance despite such
invalidity, which remaining portions shall remain in full force and effect.
4. That this ordinance shall take effect immediately from and after the date of its final
passage and publication as provided by law, and it is accordingly so ordained.

TEXAS THIS 1st day of Feb ry 1999.

Re.: Water & Sewer Rates
The City has been working with D.M.G. (David M Griffith) & Associates in
establishing appropriate water and sewer rates for both the residential and commercial
customers. This process has been on going since last year with a final workshop that took
place on January l I' of this year. Since that workshop I have worked with DMG in
making final adjustments to the rates and trying to find where we can make minor
changes to lessen the burden on our residences.
Attached to this memo are the new rates we are proposing with extra information
requested by the City Council. Both City staff and the consultants are promoting the 6%
section as our new rate structure to take effect on February Is. of 1999. The 6% means
that these rates would allow the city to increase the revenues by this percentage in order
to allow for extra growth and for new construction projected in the near future. For your
convenience we have also calculated the rates for a 3%, 4%, and a 7% revenue stream.
The schedules show you the percent increase per meter size along with the actual dollars.
I have also attached schedules of what it would cost our residences if they use
5,000 gals., 8,000 gals., 12,000 gals., and 18,000 gals. in each of the revenue streams.
The most common bill is for the 5,000 and the 8,000 gals.
Please include this proposal for water and sewer rate increases in the next council
meeting on February V. I will be present to answer any questions and to discuss the
issue more in detail with council and/or the public. I will also have follow-up
information requested by the council to explain if deemed necessary.
