HomeMy WebLinkAboutOrdinance No. 99-1093ORIGINAL CITY OF THE COLONY, TEXAS ORDINANCE NO. q% 1083 AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING ORDINANCE NO. 98-1071, PASSED AND APPROVED BY THE CITY COUNCIL ON OCTOBER 19, 1998 AND WHICH DESIGNATED AN AREA AS A DEVELOPMENT ZONE LOCATED WITHIN THE CITY LIMITS OF THE CITY; BY ADDING GUIDELINES FOR APPROVING PROJECTS FOR COMMERCIAL DEVELOPMENT; AND DECLARING AN EFFECTIVE DATE WHEREAS, the City Council did adopt Ordinance No. 98-1071 on October 19, 1998 designating a development area within the city limits of the city; and WHEREAS, the City Council finds it necessary to amend such ordinance by adding guidelines for approving projects for commercial use: WHEREAS, the rules (the "Rules") of the Texas Department of Economic Development ("Department") set forth special procedures for approval of commercial projects in development area; and WHEREAS, this City Council desires to authorize the financing of certain projects for commercial uses as provided in the Development Corporation Act 1979 ("the Act") and the Rules by establishing area that qualify as development area; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That Ordinance 98-1071 shall be amended by adding the following: A. In reliance upon the Act and Rules of the Department, the area described in Exhibit A (and shown on the map attached as Exhibit B), is the development area (hereinafter, the "Development Area") by reason that these area should be developed in order to meet the development objectives of the city; and B. The availability of financing of projects for commercial uses under the Act will contribute significantly to said development of the Development Area. follows: C. The overall objectives of the City for development of the Development Area are as 1. To promote the present and prospective health, safety, rights to gainful employment, and general welfare of the people of the City and the State. 2. To promote the continued existence, development, and expansion of commerce and industry essential to the economic growth of the City and the full employment, welfare, and prosperity of its citizens. 3. To encourage the economic growth and stability of the City by increasing and stabilizing the property tax base, and promoting commerce within the City and the State. D. This City Council hereby finds, determines, declares and represents to the Department that the City's best estimates at the time of the adoption of this ordinance do not indicate that any public improvements need to be made in the Development Area. E. This City Council, in order to enhance its development efforts, desires and authorizes all commercial projects in the Development Area that constitute, or that are functionally related and subordinate to, hotels, motels, retail sales and service establishments, office buildings, and other "commercial" activities. F. This City Council will not approve any projects for commercial uses in the Development Area unless the applicant desiring approval of such project demonstrates to the satisfaction of this City Council that: 1. The project conforms with the authorization and limitations provided in Section 1.0 of this ordinance. 2. The project will significantly contribute to the fulfillment of the overall development objectives of the City in the Development Area: 3. The project conforms to the project approval standards of the Rules and this ordinance by increasing or stabilizing employment opportunities, significantly increasing or stabilizing the property tax base, and promoting commerce within the City and the State; and 4. The project is in furtherance of the public purposes of the Act. G. This City Council hereby covenants and represents that it will review all descriptions of projects to be located within the Development Area to be determined whether such projects are consistent with the City's objectives for development of the Development Area. Section 2. This ordinance is adopted for the purpose of satisfying the conditions and requirements of the Act and the Rules, for the benefit of the Corporation, the City, the City Council, and the residents of the City, and all other interested persons.
