D AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH MINOR'S LANDSCAPING SERVICES FOR MOWING SERVICES; ATTACHING THE APPROVED FORM OF CONTRACT AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the City Manager of the City of The Colony, Texas is hereby authorized to execute on behalf of the City a contract with Minor's Landscaping Services for mowing services. The approved form of contract is attached hereto as Exhibit "A", and made a part hereof for such purposes. SECTION 2. This Ordinance shall take effect immediately from and after its passage by the City Council of the City of The Colony, Texas. Hicks, TRMC, City Secretary APPROVED AS TO FORM: City A ey CITY OF THE COLONY, TEXAS AGREEMENT This agreement is entered into by the City of The Colony, Texas, hereinafter referred to as the "City", and Minor's Landscaping Services, hereinafter referred to as the "Contractor". A. Contractor hereby agrees to provide materials and perform the labor necessary for the completion o£ 1. Mowing, trimming and other services as specified in City of The Colony Bid No. 85 -99 -05 -MOW and directed by The Colony Parks and Recreation Department: a. Pocket Parks b. Municipal Buildings C. Hidden Cove Park d. State Highway 121 Right-of-way e. Medians and Parkways B. Contractor shall provide proof of insurance in accordance with V.A.C.S. requirements. C. Contractor agrees to defend, indemnify and hold harmless the city from all damages, costs, expenses, and attorney fees for all claims and suits including claims and suits for death, personal injury, and property damage, arising out of, or connected with, the work performed under this contract whether or not caused in whole or in part by the negligence of the city, its agents, or employees. D. All material is guaranteed to be as specified, and the above work is to be performed in accordance with the specifications submitted for above work and completed in a substantial workmanlike manner for the sum of: Five Hundred eight dollars ($508.00) per mowing - Pocket Parks Two hundred seventy-four dollars and thirty-three cents ($274.33.00) per mowing - Municipal Buildings Seven Hundred Ninetv-one dollars and fifty cents ($791.50 per mowing — Hidden Cove Park broken out as follows: Section #1 (weekly) - $143.00 per mowing Section #2 (bi-weekly) - $564.50 per mowing Section #3 (monthly) - $84.00 per mowing Five Hundred eighteen dollars and no cents ($518.00) per mowing — State Highway 121 Right-of-way Mowing Contract - 1999 One Thousand One Hundred Thirty-seven dollars and no cents ($1,137.00 per mowing – Medians and Parkways Less a 2% discount for award of all mowing contracts as submitted in the bid, with payments to be made as follows: Invoices are to be presented to the City of The Colony by the first (1st) of each month, and shall be paid in accordance with the financial procedures for the City of The Colony. I. In the event contractor defaults on this contract, the City of The Colony may procure the services from other sources and hold this contractor responsible for any excess cost occasioned thereby.
