In order ~o resolve these issues in a mn,mcr ~ to both the City and the Telephone Comptmy, the C~ty and the Telephone Company have chosen the method of determi,,i,~g the amount of compensation F~ovided for in this Ordinance to e~im~nnte the expense and time relatcd to audits, to achieve administ~tive simplicity, to provide the City with predictable revenues and an oppommity t'o~ growth and to avoid thc expense and delny~ of further litigation which otherwise wzmld be necessary to resolve the WHEREAS, it is to the mutual advamage of both ~he City and the Telephone Company that an agrccmcnt should be entered into between the Telephone Company and the City establishing the conditions under which the Telephonc Company shall ma~Utin and consU'uct its physical plant in the City in the future; NOW, TI41~'ORE, BE IT ORD~ BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, THAT: SECTION L PURFOSE. Pumumt to thc laws of the State of T__-~_ % the City Chnrtcr and this Ordinance, thc Telephone Company has the non-exclusive right and privilege to use the public rights-of-way in the City for the opemti,~ of a Company may use such fi~hls-of-way for iu ~lecommuaica~ms facilities.
