State of Tcxas, and subject to the reasonable e~ercise of thc powers granted by and under
said laws to the City and as rcflccted in l~ior Ordinanccs of thc City;, and
WHEREAS, the Telephone Company has operated its telecommunications business
t~ thc city. under suc~s~ive opg__._~cs of the Cit,/, t~c tm of whiO ~s ~ No.
agreement based upon a percentage of gross receipts received by thc Telephon~ Company
from certa~ scr~e~ rendered witch the corporate ,mi~s of the City;, and

technology, changes in stat~ and f~leral law, sad e~ ia the a~.~u~llag practices
mandatcd by thc Uniform SysMm of Accounts promul~ted by the Federal C_.~mmunications
Courts, sion ("FCC~, along with regulatory requirem~u of the T."-n- Public Utility
Co,,~-,ion ('PUC"), have caused the tra~ti~___n! method of dete,.~i;nin~ the amount of
compensation to municipalities to become admini~trativeb] ~_ca~. for
telecommunications utilities. In order ~o resolve these issues in a mn,mcr ~ to both
the City and the Telephone Comptmy, the C~ty and the Telephone Company have chosen
the method of determi,,i,~g the amount of compensation F~ovided for in this Ordinance to
e~im~nnte the expense and time relatcd to audits, to achieve administ~tive simplicity, to
provide the City with predictable revenues and an oppommity t'o~ growth and to avoid thc
expense and delny~ of further litigation which otherwise wzmld be necessary to resolve the
WHEREAS, it is to the mutual advamage of both ~he City and the Telephone
Company that an agrccmcnt should be entered into between the Telephone Company and
the City establishing the conditions under which the Telephonc Company shall ma~Utin and
consU'uct its physical plant in the City in the future;
NOW, TI41~'ORE, BE IT ORD~ BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS, THAT:
SECTION L PURFOSE. Pumumt to thc laws of the State of T__-~_ % the City
Chnrtcr and this Ordinance, thc Telephone Company has the non-exclusive right and
privilege to use the public rights-of-way in the City for the opemti,~ of a
Company may use such fi~hls-of-way for iu ~lecommuaica~ms facilities. The Telephone
teleco~anications service and to the ,rmir.~.nance of a teleoco~uonicatitms busings by thc
Telephone Company in the City s~n~ remain a~ now conm~acted, subject to such ehnnges
public health nnd safety by t~- City in the czexcise of its lawful powe~ and such clmnge~ and
telecommunications business. T'ne tenm of this Ordi,,,,,~e shall apply throughout the City,
and to all operations of the Telephone Company within the City, and shall include all
operations and fncilifies used in whole or in lXZn in the provision o~ telecommunications
is not authorized to provide cable television servicc as a cable opcrator in ,_1~_ City under this
Ordinance, but must first obtain a franchise f~m the City for thnt purpose, under such terms

SF_.C'I~ON 6. A'I-I-A~ TO POL~ AND SPACE IN DUC'rS. Nothing
co~tailled in thi, On~iliallce shall be corlRl'ued to r~luirc of ~'mit aay pole attaclunents
for elec~-ic ]~ht or power wires or communications facilities or systems not provided by thc
Telephone Company to bc attached to the Telephone Company's polcs or other physical
phmt or placed in the Telephone Company's conduit. I~ the City desires pole attachments
for electric light or power wires or commtlllicatiOl~ f~lci~ti~l~ or systems not F~ueided by thc
Telephonc Comp~my, or if the City desires to place comm~mi,~ons facilities or systems not
provided by the Telephone Company in any Telephone Comp~my duct, then a further
sepn~te, noncon~ngent agreement shrill be a prerequisite to such attachment(s) or such usc
of any duct by the City. Not~-g conutined in this Ordi-n,~ce .*b-I! obligate or restrict the
Telephone Company in entcrcising its rights voluaiati/y to enter into pole attacluncnt, pole
ungc, joint ownenhip or other wire space or facilities a~.ements with li~t and/or power
companies or with other wire-using companies which a~e authorized to operate within the
City.
SECTION 7. STREETS TO BE RESTORt~ TO PRE-EXISTING
CONDITION. The stuface of any street, alley, avenue, highway or public placc disturbed
by the Telephone Company in build~n.~ comuuctm& renewing or mamlaJni~ its
telecommtmications system shall be restored within 8. Feasonnhle t~nc ~ ~ completion
of thc work to as good a condition as before the commencemeat of work and ma/ntaincd
to the satisfaction of the City Coun~ or of any City off,chi to whom such duties have been
or may be delegated for one (1) year from the date the surface of said su-eet, alley, avenue,

The Telephone COml~ny shall adjust its l~llln~s to customers to account for
undercollection or ovcrcollection of the ~rge due thc City.
B. The Charge for each year shall be paid in four (4) cqual payments. The first
tmyment under this Ord~nn,Ce shall bc duc on the last day of the fifth month following the
effective date hereof, with subsequent paymcnts due on ',he last day of each third successive
