ORDINANCE NO. ~2t~-/~ 4oQ-
AN ORDINANCE OF THE CITY OF THE COLONY,
TEXAS AMENDING CHAPTER 10, "HEALTH AND
SANITATION" OF THE CITY'S CODE OF ORDINANCES,
BY AMENDING SECTION 10-54, "COMPLIANCE
PROCEDURES" TO PROVIDE FOR A SCHEDULE OF
FEES TO BE CHARGED BY THE HEALTH AUTHORITY;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of The Colony desires to amend the Health and Sanitation
ordinance of the City, the same being Chapter 10, Section 54 of the Code of Ordinances,
as amended; and
WHEREAS, the Fees Committee of the City of The Colony held a meeting on
May 21, 1998, and made recommendations to the City Council for amending the Health
and Sanitation ordinance with regard to fees to be charged by the Health Authority;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF THE COLONY, TEXAS:
Section 1. Incorporation of premises. The above and foregoing premises are
tree and correct and are incorporated herein and made a part hereof for all purposes.
Section 2. Amendment. That Chapter 10, Section 10-54 (a) (2) "Fees" is
hereby amended as follows:
(2) Fees:
Fees charged by the regulatory authority for permits and plan review as
required by thi6~ article, shall be in accordance with a schedule offees as
adopted by the City Council and as amended jS'om time to time. Initial
permit fees shall be prorated based on the month in which the permit is
requested
Applicants shall not, under any circumstances be entitled to a refund of
perm#fees after an application has been filed Upon receipt of such an
application, the regulatory authority shall make an inspection of the
establishment to determine compliance with the provisions of this article.
When inspection reveals that the applicable requirements of this article
have been met, a permit shall be issued to the applicant by the regulatory
authority.
Section 3. Penalty: It shall be unlawful for any person to violate any
provision of this Ordinance, and any person violating or failing to comply with any
provision hereof shall be fined, upon conviction, in an amount not to exceed two
thousand dollars ($2,000.00) for each offense, and a separate offense shall be deemed
committed each day during or on which a violation occurs or continues.
Section 4. Severability. The sections, paragraphs, sentences, phrases, clauses
and ~vords of this Ordinance are severable, and if any section, paragraph, sentence,
phrase, clause or word in this Ordinance or application thereof to any person or
circumstance is held invalid or unconstitutional by a Court of competent jurisdiction,
such holding shall not affect the validity of the remaining portions of this Ordinance, and
the City Council hereby declares that it would have passed such remaining portions of
this Ordinance despite such invalidity, which remaining portions shall remain in full
force and effect.
Section 5. Effective date. This Ordinance shall become effective from and
after its date of adoption and publication as provided by law.
