ORDINANCE NO. 638
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING
THE CODE OF ORDINANCES AMENDING CHAPTER 12, BY AMENDING
WATER AND SEWER CODES AS ADOPTED BY ORDINANCE NO. 449,
PASSED AND APPROVED BY THE CITY COUNCIL THE 29TH DAY OF
SEPTEMBER, 1986; AMENDING SECTION 6 OF THE WATER AND
SEWER CODES, RELATING TO RATES; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A PENALTY; DECLARING AN
EMERGENCY; AND PROVIDING AN EFFECTIVE DATE.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COONCIL OF THE
CITY OF THE COLONY, TEXAS:
Section 1. That Section 6 of the Water and Sewer Codes
as adopted by Ordinance No. 449 passed and approved by the City
Council on the 29th day of September, 1986, shall be amended in
the following particulars:
A. Section 6.1 Any person receiving water from the "City"
shall be charge and pay for such water according to the following
Rates:
(a) Single and Multiple Residential and Commercial
During construction and
prior to initial occupancy $10.00
After initial occupancy:
0-2,000 gallons $10.00
All over 2,000 gallons $2.10 per 1,000 gallons
6.2 Any person receiving sewer service from the City
shall be charged and pay for such service according to the
following rates:
(a) Single and Multiple Residential
$9.00 minimum
0-2,000 gallons $2.00 per 1,000 gallons
Over 2,000 gallons based on a three (3) month winter
average water use. These 3 months will reflect the lowest
months of useage.
For new customers, when no three (3) month average
exists a monthly average of 5000 gallons will be established.
(b) Commercial (based on water meter reading)
0-2,000 gallons $10.00
2,001 100,000 gallons $2.10 per 1,000 gallons
6.3 Any person receiving refuse collection service from the
City shall be charged and pay for such service according ~o the
following rates"
(a) Each customer whose account is classified as a single
residential unit, which is not part of a multiple residential
unit of five or more single residential units, and who receives
refuse collection service, shall be charged a fee to be
established annually by Council Resolution.
Section 2. If any section, article paragraph, sentence,
clause, phrase or word in this ordinance, or application thereto
any persons or circumstances is held invalid or unconstitutional
by a Court of competent jurisdiction, such holding shall not
affect the validity of the remaining portions of this ordinance;
and the City Council hereby declares it would have passed such
remaining portions of this Ordinance despite such invalidity,
which remaining portions shall remain in full force and effect.
Section 3. All ordinances, resolutions and orders
heretofore passed, adopted and made, or any part of the same,
affecting rates charges and policies for sales made or services
rendered by the water and sewer systems of the City of The
Colony, Texas which are in conflict with this ordinance, shall be
and the same are hereby in all things repealed.
Section 4. Any person, firm or corporation violating any
of the provisions of this ordinance shall be deemed guilty of a
misdemeanor and upon conviction thereof shall be fined in a sum
not exceeding One Thousand Dollars ($1000.00) and a separate
offense shall be deemed committed upon each day during or on
which a violation occurs or continues.
Section 5. This ordinance shall be effective from and
after its passage.
