ORDINANCE NO.
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING
THE CODE OF ORDINANCES BY AMENDING CHAPTER 11 RELATING
TO THE LIBRARY BOARD BY AMENDING SECTION 11-2; BY
AMENDING CHAPTER 14 RELATING TO THE PARK AND RECREATION
BOARD BY AMENDING SECTION 14-2(C)(G); BY AMENDING
CHAPTER 17 RELATING TO THE PLANNING AND ZONING
COMMISSION BY AMENDING SECTION l?-2(D); AND BY AMENDING
APPENDIX A-ZONING RELATING TO THE BOARD OF ADJUSTMENT
AND APPEALS BY AMENDING SECTION 21-100; PROVIDING A
SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND
PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS:
Section 1. That Section 11-2 of the Code of ordinances
of the City of The Golony, Texas shall be amended to read as
follows:
..." The Library Board shall consist of five (5) members and
two (2) alternates who shall be residents and qualified
voters of the City of The Colony ..... Appointments of members
and alternates shall be made by the Mayor and City Council
in January of each year."...
Section 2. That Section 14-2 of the Code of Ordinances
shall be amended to read as follows:
Section 14-2 (a) Membership; officers:
"The Park and Recreation Board shall consist of seven (7)
members who shall be residents and qualified voters of the
City of The Colony. The board shall select from among its
members a chairman and a vice chairman. The chairman and
vice chairman shall serve in that capacity for a period not
to exceed one year. The chairman shall not serve
consecutive terms. Appointments of members shall be made by
the Mayor and Gity Council in January of each year.
Appointments shall be for a two year term. Vacancies shall
be filled by appointment by the Mayor and Gity Council for
the remaining portion of the unexpired term of the vacant
position being filled. The members of the Board shall be
subject to removal from office by the City Council for any
cause deemed sufficient by the Council for removal."
Section 14-2 (b) Duties
"(1) Hold monthly meetings at regular stated times, such
meetings to be open to the public and subject to the
provisions of the Texas Open Meetings law;
(2) To serve in an advisory capacity concerning the
acquisition, maintenance, operation and use of parks,
playgrounds, and open spaces within the city."
Section 14-2 (c), (d), (e), (f) and (g) shall be deleted in
their entirety.
Section 3. That Section 17-2 of the Code of Ordinances
of the City of the Colony shall be amended to read as follows;
"Section 17-2 (b) Members of the commission shall be
residents and qualified voters of the City. A member of the
Lewisville Independent School District Board of Trustees and
the Fire Chief of the City shall serve as ex-officio members
of the commission.
Section 17-2 (d) Appointments of members shall be made by
the Mayor and City Council in January of each year. Terms
shall be for a period of two years. Vacancies shall be
filled by appointment by the Mayor and City Council for the
remaining portion of the unexpired term of the vacant
position being filled. The members of the Commission shall
be subject to removal from office by the City Council for
any cause deemed sufficient by the Council for removal."
Section 17-2 (e) shall be deleted in its entirety.
Section 4. That Section 21-100 of Appendix A-Zoning of
the Code of Ordinances shall be amended to read as follows:
~The Board of Adjustment shall consist of five (5) members
and two (2) alternates, who shall be residents and qualified
voters of the City. Appointments of members and alternates
shall be made by the Mayor and City Council in January of
each year. Terms shall be for a period of two (2) years.
Vacancies shall be filled by appointment by the Mayor and
City Council for the remaining portion of the unexpired term
of the vacant position being filled." .....
Section 5. That tbis ordinance shall be cumulative of
all other ordinances of the City affecting Advisory Boards and
shall not repeal any of the provisions of said ordinances except
in those instances where provisions of those ordinances are in
direct conflict with the provisions of this ordinance.
Section 6. The fact that the present ordinances and
regulations of the City of the Colony, Texas, are inadequate to
properly safeguard the health, safety, morals, peace, and general
welfare of the inhabitants of the City of The Colony, Texas,
creates an emergency for the immediate preservation of the public
business, property, health, safety, and general welfare of the
public which requires that this ordinance become effective from
and after the date of its passage and it is accordingly so
