AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING CHAPTER
12, ARTICLE I, SECTION 2, RELATING TO THE WATER AND SEWER CODE,
BY AMENDING SECTION 6, OF THE WATER AND SEWER CODE AS ADOPTED BY
ORDINANCE NO. 449 SEPTEMBER 29, 1986; PRESCRIBING AND SETTING
USER RATES AND CHARGES FOR SALES AND SERVICES OF THE WATER SYSTEM
OF THE CITY OF THE COLONY, TEXAS TO CUSTOMERS LIVING OUTSIDE THE
CITY LIMITS OF THE COLONY; REPEALING ORDINANCES, RESOLUTIONS,
AND ORDERS IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE;
PROVIDING A PENALTY; AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1. That certain sections of the Water and Sewer Code
as adopted shall be amended in the following particulars:
Section 6.1 Water Rates
Section 6.1 shall be amended, by adding Section 6.1 (d), which
shall read as follows:
Section 6.1 (d) Customers outside the City Limits
Customers outside the city limits shall pay one and one-half
times the water rate set for customers living inside the City.
Customers living out the city limits shall be charged and pay for
such water according to the fo]lowing Rates:
0-2,000 gallons $15.00
All over 2,000 gallons $3.15 per 1,000 gallons
These rates are applicable to all sales or service of water. All
leakage between a meter and a building is the responsibility of
the owner, tenant or occupant of the building."
Anyone receiving City Water service must pay the above water
charges regardless of whether the building is occupied or not.
SECTION 2. Penalty
That it shall be unlawful for any person to violate any provision
of this ordinance, and any person violating any provision of this
ordinance shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be subject to a fine in any amount not
to exceed One Thousand Dollars ($1000.00), and a separate offense
shall be deemed committed upon each day during or on which a
violation occurs or continues. The City also is entitled to
pursue all other criminal and civil remedies to which it is
entitled under the authority of other statutes or other
ordinances.
SECTION 3. Failure to Pay
In addition to sanctions provided for by this ordinance, the
City is entit, led to exercise sanctions provided for by the other
ordinances of the City for failure to pay the bill for water and
sanitary sewer service when due.
SECTION 4. Severabilit. y
Provisions of this ordinance shall be, and they are hereby,
declared to be severable, and should any portion of it be
declared to be invalid for any reason by a court of competent
jurisdiction, such holding shall not affect the remaining
portions thereof.
SECTION 5. Other Ordinances and Resolutions Repealed
All ordinances, resolutions, and orders heretofore passed,
adopted and made, or any part of the same, affecting rates,
charges and policies for sales made or services rendered by the
water and sewer system of the City of The Colony, Texas which are
in conflict with this ordinance, shall be and the same are hereby
in all things repealed.
SECTION 6. Effective Date
This ordinance shall become effective upon the 1st day of
February 1990.
