ORDINANCE NO. 664
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING
CHAPTER 12 OF THE CODE OF ORDINANCES BY AMENDING THE
WATER AND SEWER CODES AS ADOPTED BY ORDINANCE NO. 449
AS APPROVED BY THE CITY COUNCIL THE 29TH DAY OF
SEPTEMBER, 1986 BY DELETING CHAPTER 2 OF THAT CODE;
AMENDING CHAPTER 12 BY ADDING ARTICLE III RELATING TO
INDUSTRIAL WASTE; REQUIRING PERMITS TO DISCHARGE
INDUSTRIAL WASTE INTO THE SANITARY SYSTEM; REGULATING
INDUSTRIAL WASTE SURCHARGE RATES; AUTHORIZING THE
PROMULGATION OF REGULATIONS PERTAINING TO SUCH
PERMITTING; PROVIDING DEFINITIONS; REPEALING
ORDINANCES, RESOLUTIONS AND ORDERS IN CONFLICT
HEREWITH; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A
SAVINGS CLAUSE; PROVIDING A PENALTY; AND PROVIDING AN
EFFECTIVE DATE
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS:
SECTION 1. That Section 12 of the Code of Ordinances
shall be amended by amending the Water and Sewer Codes as
adopted, in the following particulars:
Chapter 2 Industrial Waste
Chapter 2 of the Water and Sewer Code shall be deleted in
it's entirety.
SECTION 2. That Chapter 12 of the Code of Ordinances
shall be amended by adding Article III relating to Industrial
Waste, which shall read as follows:

THE FOLLOWING TERMS AND DEFINITIONS, WITHOUT LIMITATION BY REASON
OF SPECIFICATION, SHALL APPLY UNLESS THE CONTEXT SPECIFICALLY

SECTION 3. Savin~s Clause
That this ordinance shall be cumulative of all other
ordinances of the City affecting industrial was~and shall tepee% any
of the provisions of said ordinances except in those instances
where provisions of those ordinances are in direct conflict with
the provisions of this ordinance.
SECTION 4. Penalty
That it, shall be unlawful for any person to violate any
provision of this ordinance, and any person violating any
provision of this ordinance shall be deemed guilty of a
misdemeanor and upon conviction thereof shall be subject to a
fine in any amount not to exceed One Thousand Dollars ($1000.00),
and a separate offense shall he deemed committed upon each day
during or on which a violation occurs or continues. The City
also is entitled to pursue all other criminal and civil remedies
to which it is entitled under the authority of other statutes or
other ordinances.
SECTION 5. Severabilit. y
Provisions of this ordinance shall be, and they are hereby,
declared to be severable, and should any portion of it be
declared to be invalid for any reason by a court of competent
jurisdiction, such holding shall not affect the remainin§
portion, s thereof.
SECTION 6. Other Ordinances and Resolutions Repealed
All ordinances, resolutions, and orders heretofore passed,
adopted and made, or any part of the same, relating to Industrial
Waste, of the City of The Colony, Texas which are in conflict
with this ordinance, shall be and the same are hereby iz~ all
things repealed.
SECTION 7. Effective Date
This ordinance shall be effective from and after its
passage, and publication as required by law.
