AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS
AMENDING THE CODE OF ORDINANCES OF THE CITY
BY AMENDING CHAPTER 9.5, ARTICLE II~ AMENDING
SECTION 9.5-21; R~-~TING TO THE FLOODPLAIN
ADMINISTRATOR DESIGNATION= PROVIDING THAT
THIS ORDINANCE SHALL BE CUMULATIVE OF
OTHER ORDINANCES OF THE CITY RELATING TO
FLOODPLAIN= EXCEPT TO THE EXTENT OF CONFLICT
HEREWITH; PROVIDING AN EMERGENCY= AND
PROVIDING ANEFF~CTIVE DATE
NO~, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF THE COLONy, TEXAS=
Section ! That Chapter 9.5, rtlcle ii of the Code
of Ordinances shall be amendsd in the following particulars:
ARTICLE ii - ADMINISTi~TION AND ENFORCEMENT
Section 9.5-2! Administrator - Designation.
"The Building Official is hereby appointed the floodplain
administrator to administer and implement 9he provisions of this
chapter and other appropriate sections of 44 CFR (National Flood
Insurance Program regulations) pertaining to floodplain
management."
Section 2. If any section, article paragraph,
sentence, clause, phrase or word in this ordinance, or
application thereto any persons or circumstances is held invalid
or unconstitutional by a Cour~ of competent jurisdiction, such
holding shall not affec~ the validity of the remaining portions
of this ordinance~ and the City Council hereby declares it would
have passed such remaining portions of this Ordinance despite
such invalidity, which remaining portions shall remain in full
force and effect.
Section 3. That this ordinance shall be cumulative of all
other ordinances of the City affecting floodplain and shall not
repeal any of the provisions of saiO ordinances except in those
instances where provisions of those ordinances are in direct
conftic~ with the provisions of ~his ordinance. ·
Section 4. The fact ~hat the present ordinances and
regulations of the City of the Colony, Texas, are inadequate to
properly safeguard the health, safety, morals, peace, and general
welfare of the inhabitants of the City of The Colony, Texas,
creates an emergency for the immediate preservation of the public
business, property, health, safety, and general welfare of the
public which requires that %his ordinance become effective from
and after ~he date of its passage and it is accordingly so
ordained. ~ .
