ORDINANCE NO.
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AUTHORIZING THE
CITY MANAGER TO ENTER INTO A CO--CT WITH
FOR THE MOWING OF STEWART CREEK PARK; IN THE AMOUNT
OF $~g2&5,~ATTACHING THE APPROVED FORM OF CONTRACT AS EXHIBIT
"A"; AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
Section 1. That the City Manager of the City of The Colony, Texas is hereby
authorized to execute on behalf of the City a contract with k, gt~o N '~ u r LEE_
for the mowing of Stewart Creek Park. in the amount of .~~. The approved form
of such contract is attached hereto as Exhibit "A", and made a part hereof for such purposes.
Section 2. This Ordinance shall take effect immediately from and after its passage
by the City Council of the City of The Colony, Texas.

AGREEMENT
This agreement is entered into by the City of'The Colony, Texas, hereinafter referred to as
the "City", and The Lawn Butler hereinafter referred to as the "Contractor".
A. Contractor hereby agrees to provide materials and perform the labor necessary for
the completion of:
1. Mowing, trimming and other services required on medians and parkways
within the City of the Colony, and as specified by The Colony Public Works
Department in the Bid Specifications, Bid No. 61-92-02-MED
2. Mowing, trimming and other services required at Stewart Creek Park, as
specified by The Colony Public Works Department in the Bid Specifications, Bid No.
61-92-01-STCK.
B. Contractor agrees to provide above named service once a week for 26 weeks
beginning March 1, 1992.
C. Contractor shall provide proof of insurance in accordance with V.A.C.S.
requirements.
D. Contractor agrees to defend, indemnify and hold harmless the city from all damages,
c6sts, expenses, and attorney fees for all claims and suits including claims and suits for
death, personal injury, and property damage, arising out of, or connected with, the work
performed under this contract whether or not caused in whole or in part by the negligence
of the city, its agents, or employees.
E. All material and labor is guaranteed to be as specified, and the above work is to be
performed in accordance with the pec~ficat~ons subnntted for above work and completed
in a substantial workmanlike manner for the sum of:
1. Medians and Parkways
Four Hundred nine .ty-five dollars ($495.00) per mowinl~
2. Stewart Creek Park
· Two hundred two dollars and fifty cents ($202.50) per m0win~
with payments to be made as follows:
Invoices are to be presented to the City of The Colony by the first (lst) of each
month, and shall be paid in accordance with the financial procedures for the City of The
Colony.
