AN ORDINANCE OF THE CITY OF THE COLONY,
TEXAS AMENDING APPENDIX-A ZONING OF THE
CODE OF ORDINANCES BY AMENDING SECTION 11-700
RELATING TO SPECIAL AREA AND ACCESSORY
BUILDING REGULATIONS; BY ADDING SECTION 11-704
RELATING TO HEIGHT RESTRICTIONS; PROVIDING
FOR A DECREASE IN THE MAXIMUM HEIGHT OF
DETACHED ACCESSORY BUILDING; PROVIDING A
SAVINGS CLAUSE; PROVIDING A PENALTY NOT TO
EXCEED ONE THOUSAND DOLLARS ($1,000.00) FOR
EACH OFFENSE AND A SEPARATE OFFENSE SHALL
BE DEEMED COMMIT'FED UPON EACH DAY DURING
OR ON WHICH A VIOLATION OCCURS OR
CONTINUES; PROVIDING A SEVERABILITY CLAUSE;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the City Council of the City of The Colony, Texas (the "City") is
empowered pursuant to article 1011d of the Texa~ Revised Civil Statutes to amend the
Zoning Ordinances of the City; and
WHEREAS, Public Notice was given in compliance with State law and a Public
Hearing was conducted with respect to the amendment to the City's Zoning Ordinances as
hereinafter set forth; and
WHEREAS, after due deliberation and consideration of all the information
submitted to the City Council, including the information submitted during the Public
Hearings, the City Council has concluded that it is in the public's best interest and in
support of the health, safety, morals and welfare of the City that Appendix A-Zoning of the
Code of Ordinances of the City be amended as hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS:
Section 1. That all of the above premises are found to be true and correct and are
incorporated into the body of this ordinance as if copied in their entirety.
Section 2. That Appendix A-Zoning of the Code of Ordinances of the City of The
Colony, Texas is hereby amended in the following particulars, and that all other sections,
subsections, sentences, clauses words and phrases of Appendix A-Zoning are not amended
but are hereby ratified, verified, approved and affirmed:
A. That Section 11-700 of the Code of Ordinances relating to Special Area and
Accessory Building Regulations be amended by adding Section 11-704 to read as follows:
"11-704 Height Restrictions. In the SF4, SF-3, SF-2, SF-1, D, TH, MH, and MF-1,
MF-2, MF-3, MF-4 districts, the maximum height of any detached accessory building shall
not exceed eight feet (8') with a roof pitch not to exceed that of the main building."
Section 3. This ordinance shall be cumulative of all other ordinances of the City
affecting zoning and shall not repeal any of the provisions of said ordinances except in those
instances where provisions of those ordinances which are in direct conflict with the
provisions of this ordinance.
Section 4. Any person violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not
less than One Dollar ($1.00) nor more than One Thousand Dollars ($1,000.00) and a
separate offense shall be deemed committed upon each day during or on which a violation
occurs or continues.
Section 5. The fact that the present zoning ordinances and regulations of the City are
inadequate to properly safeguard the health, safety, morals, peace and general welfare of
the inhabitants of the City creates an emergency for the immediate preservation of the
public business, property, health, safety and general welfare of the public which requires that
this ordinance shall become effective from and after the date of its final passage and
publication as provided by law, and it is accordingly so ordained.
