HomeMy WebLinkAboutOrdinance No. 750 CITY OF THE COLONY, TEXAS ORDINANCE NO. 7 ~ AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING THE CODE OF ORDINANCES OF THE CITY BY AMENDING CHAPTER 9, BY DELETING DIVISION V OF THE 1991 UNIFORM FIRE CODE, AS ADOPTED; BY ADOPTING APPENDICES TO THE 1991 UNIFORM FIRE CODE; PROVIDING A PENALTY; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That Chapter 9, Section 2 of the Code of Ordinances of the City of The Colony shall be amended by adding the following: Sec. 9-2(c) "The Uniform Fire Code heretofore adopted, is hereby amended as follows: Division V of the 1991 Uniform Fire Code relating to STATIONARY TANK STORAGE, ABOVEGROUND, OUTSIDE OF BUILDINGS is hereby deleted in its entirety. Sec. 9-2(d) Part VIII - Appendices of the 1991 Uniform Fire Code shall be adopted by reference as follows: A. Division I - EXISTING BUILDINGS - shall be adopted in its entirety. Appendix I-A - LIFE-SAFETY REQUIREMENTS FOR EXISTING BUILDINGS OTHER THAN HIGH RISE. Appendix I-B - LIFE SAFETY REQUIREMENTS FOR EXISTING HIGH-RISE BUILDINGS. · Appendix I-C - STAIRWAY IDENTIFICATION. B. Division II - SPECIAL HAZARDS - Shall be adopted as follows: Appendix II-A - SUPPRESSION AND CONTROL OF HAZARDOUS FIRE AREAS, shall be adopted in its entirety. · Appendix II-B PROTECTION OF FLAMMABLE AND COMBUSTIBLE LIQUIDS IN TANKS IN LOCATIONS SUBJECT TO FLOODING. 1. Section 2 relating to ABOVEGROUND TANKS shall not be adopted and is hereby deleted in its entirety. Appendix II-C - MARINAS, shall be adopted in its entirety. Appendix II-D - RIFLE RANGES, shall be adopted in its entirety. Appendix II-E - HAZARDOUS MATERIALS MANAGEMENT PLANS AND HAZARDOUS MATERIALS INVENTORY STATEMENTS, shall be adopted in its entirety. C. Division III - FIRE PROTECTION - shall be adopted in its entirety. · Appendix III-A - FIRE FLOW REQUIREMENTS FOR BUILDINGS. · Appendix III-B FIRE HYDRANT LOCATIONS AND DISTRIBUTION. · Appendix III-C - TESTING AUTOMATIC SPRINKLER AND STANDPIPE SYSTEMS. · Appendix III-D - BASEMENT PIPE INLETS. D. Division IV - SPECIAL COMBUSTION HAZARDS shall be adopted in its entirety. · Appendix IV-A - INTERIOR FLOOR FINISH. · Appendix IV-B - CHRISTMAS TREES. E. Division V - STANDARDS - shall be adopted in its entirety. · Appendix V-A - NATIONALLY RECOGNIZED STANDARDS OF GOOD PRACTICE. F. Division VI - INFORMATIONAL - Shall be adopted as follows: · Appendix VI-A - HAZARDOUS MATERIALS CLASSIFICATIONS, shall be adopted in its entirety. · Appendix VI-B - EMERGENCY RELIEF VENTING FOR FIRE EXPOSURE FOR ABOVEGROUND TANKS, shall not be adopted and is hereby deleted in its emirety. · Appendix VI-C - MODEL CITATION PROGRAM, shall be adopted in its entirety. · Appendix VI-D - REFERENCE TABLES FROM THE UNIFORM BUILDING CODE, shall be adopted in its entirety. · Appendix VI-E - RECOMMENDED SEPARATION DISTANCES FOR EXPLOSIVE MATERIALS, shall be adopted in its emirety. · Appendix VI-F - UNIT CONVERSION TABLES, shall be adopted in its entirety." Section 2. If any section, article paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the emmnmg portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 3. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be subject to a fine in a sum not to exceed Two Thousand Dollars ($2000.00) for each offense and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 4. The fact that the present ordinances and regulations of the City of the Colony, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the inhabitants of the City of The Colony, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety, and general welfare of the public which requires that this ordinance become effective from and after the date of its passage and it is accordingly so ordained.
