AN ORDINANCE OF THE CITY OF THE COLONY~ TEXAS~ APPROVING A BOUNDARY ADJUSTMENT AGREEMENT WITH THE CITY OF PLANO AND THE CITY OF HEBRON; AUTHORIZING THE MAYOR TO EXECUTE THE BOUNDARY ADJUSTMENT AGREEMENT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Cities of Plano and The Colony have heretofore been involved in litigation concerning land part of which was also claimed by the Town of Hebron; and WHEREAS, the Cities of Plano and The Colony and the other parties to the suit have settled their litigation and have requested the Town of Hebron to enter into a Boundary Adjustment Agreement with them to resolve the boundary line between Plano and The Colony adjacent to what are referred to as the "Dillard Tract," the "White Tract," and the "IBM Tract," more particularly described in the Agreement; and WHEREAS, the city Council of the City of The Colony has determined that the Boundary Adjustment Agreement and the accompanying Settlement Agreement are proper and lawful, and are in the best interests of the City of The Colony and its citizens; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the Boundary Adjustment Agreement presented to the City Council for the City of The Colony, a true and correct copy of which is attached hereto as Exhibit "A" and made a part hereof for all purposes, be, and the same is hereby, approved for execution on behalf of the city of The Colony. SECTION 2. That the Mayor of the City of The Colony be, and he is hereby, authorized and directed to execute such Boundary Adjustment Agreement on behalf of the City of The Colony and to deliver the same, along with a copy of this Ordinance, to the representatives of the cities of Plano and Hebron. SECTION 3. This Ordinance shall take effect immediately from and after its passage as the law in such case provides.
