AN ORDIN/~CE OF THE CITY OF THE COLONY, 'Iq~..AS~
ORDERING AN ELECTION OF THE ~UALIFIED VOTERS
OF SAID CITY ON THE FOURTH DAY OF MAY, 1991,
FOR TH~ PURPOSE OF ELECTING A MAYOR AND TWO
COUNCILMEMEERS FOR SAID CITY
WHEREAS, the %erin of office of the Mayor and ~wo ( 2 )
Councilmembers presently on %he City Council expires May 4, 1991;
and
WHEREAS, it is hereby found and de%ermined by ~he Mayor,
acting in his official capacity, and %he City Council ac~ing as the
governing body of %he City that it is in the best interest of %he
City and its citizens to hold an election for ~he purpose of
electing a Mayor and ~wo (2) Councilmembers to ~he City Council
Places 1 and 2; and
WHEREAS, Vernon's Ann. Civ. St., Ar%. 978 authorizes such
election; and
WHEREAS, V.A.T.S. Election Code, Art. 2.0lb specifies the da%e
on which such elec%ions may be held;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS:
Sec%ion 1. That a general election be held in and 9hroughou%
the City of The Colony, Texas on Saturday, May 4, 1991, for the
purpose of electing a Mayor and two (2) Councilmembers %o serve on
the City Council Places 1 and 2; and
Section 2. Tha% the City elec%ion precincts for ~his elec%ion
shall consist of the territory situated within ~he various Denton
Coun%y election precincts located within the corporate limi%s of
the City and bearing the following numbers, and ~he polling place
and officers of said elec%ion shall be as follows, to wit:

ABSENTEE BALLOT BOARD PRESIDING JUDGE

The Presiding Judge shall appoint not less than. two (2) nor
more than six (6) qualified election clerks to serve a~d assist in
the conduct of the election, providing that if ~he Presiding J6dge
named above actually serves as expected, the Alternate Presiding
Judge shall be one of such clerks.
By passing ~his Ordinance, ~he City Council of said City
approves and concurs in the appointment of the aforesaid election
officers. - -
Section 3. Tha~ vo~ing at and on the date of said election
shall be by paper ballo~ or by any o~her'me~ho~ as approved in'the
Texas Election Code, as amended, and said ballots shall be prin~ed
in accordance wi~h ~he Texas Election Code, as amended.
Section 4. No person's name shall be placed on the ballot as
a candidate for the position of Councilmember of the-City Council
un%il such person has filed his/her sworn application and affidavi~
as provided by the laws of ~he S~a%e of Texas a~d %he Charter of
~he City of The Colony, Texas wi~h the City Secretary at least
forty-five (45) days prior ~o ~he election date.
Section 5. All eligible City of The Colony voters shall cas%
~heir ballots a% %he aforementioned Polling Places. The polls
shall be open between 7:00 o'clock a.m. and 7:00 o'clock p.m. on
May 5, 1990.
Sec%ion 6. As ~o absentee voting for said election, paper
ballots shall be used, and such absentee vo~ing shall b~ conducted
by the City Secretary, who is hereby appointed the Clerk for
Absentee Vo~ing, at ~he City Secretary's Office a~ C~ty Hall, City
of The Colony, Texas. For the period absentee voting for said
election is permitted by law, the Clerk shall k~ep said office open
for absentee vo~ing during regular working hours of each workday.
For the purpose of additional absentee voting the Clerk shall keep
said office open on Saturday, April 27, 1991 from 10:00 a.m. to
2:00 p.m. The absentee ballots for said election shall conform to
~he requirements of %he Texas Election Code, as amended, and in so
doing shall permi~ the voters ~o vo~e for a Mayor and ~wo (4)
Councilmembers, Places 1 and 2. Each elector_ shall place an "X" in
~he space provided beside each candidate's name tha~ he/she wishes
to vote for, provided, however, that no elector shall vote for more
than one (1) candidate for Mayor or Councilmember in each Place.
Section 7. The election materials enumerated in V.A.T.S.
Election Code, Art. 1.08a, shall be printed in both English and
Spanish for use at the polling place and for absentee voting for
said election.
Section 8. Notice of said election shall be given by
publishing the no~ice at least one time, no% more than twenty-five
(25) days nor less ~han ten (10) days before ~he election, in at
leas~ one newspaper regularly published in the City, and a copy of
the no~ice shall also be filed with ~he City Secretary and another
copy shall be posted on a bulletin board in the office of the City
Secretary, a~ least twenty (20) days before the election. The City
Secretary of the City of The Colony, Texas shall keep a copy of the
notice as published, together with ~he name(s) of the newspaper(s)
and date or dates of publication.
