HomeMy WebLinkAboutOrdinance No. 707 CITY OF THE COLONY, TEXAS ORDINANCE NO. ~O~ AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING THE CODE OF ORDINANCES OF THE CITY OF THE COLONY, TEXAS BY AMENDING CHAPTER |0 SECTION 10-2 RELATING TO NOISE~ BY AMENDING SECTION |0-2 C5 RELATING TO BUILDING; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City of The Colony, Texas did adopt the Engineering Design Manual and Standard Construction Details on the T6th day of April~ |990, by adopting Ordinance No 637; and · WHEREAS, the criteria set out in the above named document does represent standard construction practices; and WHEREAS~ the City Council ! desires to standardize the requirements for construction within the City of The Colony; and WHEREAS, Chapter ]0, Article I7 Section 10-2 (C-5) currently does not conform to the requirements set out in the Engineering Design Manual and Standard Construction Details NOW~ THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. All of the above premises are hereby found to be true and correct and are hereby approved and incorporated into the body of this ordinance as if copied in their entirety. Section 2. That Chapter ]0r Article I shall be amended in the following particulars: A. Section ]0-2 (C-5) is hereby amended to read as follows: Sec. 10-2 Noise. "(c)(5) Building: (a) The erection, including excavation, demolition~ alteration~ or repair work on any building at any time other than those hours specified in Appendix C~ GENERAL, ppg 3, of the Engineering Design Manual and Standard Construction Details~ as amended; except in case of urgent necessity in the interest of public safety and convenience;" Section 5. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance~ or application thereto to any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction such holding shall not affect the validity of the remaining portions of the ordinance; and the City Council hereby declares it would have passed such remaining portions of this ordinance despite such invalidity, whicb remaining portions shall remain in full force and effect.
