HomeMy WebLinkAboutOrdinance No. 716 CITY OF THE COLONY~ TEXAS ORDINANCE NO. 7/& AN ORDINANCE OF THE CITY OF THE COLONY~ TEXAS AMENDING THE CODE OF ORDINANCES OF THE CITY BY AMENDING CHAPTER l) RELATING TO PEBDLERS AND SOLICITORS BY AMENDING SECTIONS 15-{~ 15-? AND 15-8; PROVIDING d SEVERABILITY CLAUSE; PROVIDING A PENALTY NOT TO EXCEED THE SUN OF FIVE HUNDRED DOLLARS ($500.00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE NOW~ THEREFORE~ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY~ TEXAS: Section ]. That Chapter 15 of the Code of Ordinances of the City of The Colony, Texas, is hereby amended in the following particulars and all other existing sections, subsections~ paragraphs, sentences, definitions, phrases and words of said Code of Ordinances are not amended by shall remain intact and are hereby ratified, verified and affirmed: A. That Section 15-] is amended by adding the following: Sec. ]5-1 Definitions. City Based Organization - any group maintaining an organizational structure within the city~ and which may be either registered with the State as a certified non-profit organization or nationally chartered as a service or professional organization and which is working for the betterment of the entire city. Non-profit Organization - any organization which is either registered with the State as a certified non-profit organization or nationally chartered as a service or professional organization and which is working for the betterment of the entire city. A. That Section ]5-7 is amended to read as follows: Sec. ]5-7 Investigation; term; fee; denial. "...Such permit, if granted, shall be issued as follows: Daily Permit $]0.00 Weekly Permit $25.00 Yearly Permit $100.00 solicltors/lO-lO-9l/revlsion City based and/or non-profit organizations shall be exempt from permit fees. The chief of police may refuse to issue such permit if it is found that the applicant has been convicted of a felony, or of a misdemeanor involving moral turpitude, if any of the information furnished on the application blank is found to be false, if the applicant fails or refuses to furnish the information required, or if the type of business or goods to be sold will violate some law of this state or ordinance of the city. Any applicant who has been refused issuance of a permit or license under this section shall have the right of appeal to the City Nanager. The City Manager's decision regarding an appeal shall be final .... " B. That Section 15-8 is hereby amended to read as follows: Sec. 15-8 Carrying license, permit and photographic identification. "...A fee of ten dollars ($10.00) shall be charged for every photographic identification badge issued." Section 2. If any section, article paragraph, sentence, clause, phrase or word in his ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 3. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be subject to a fine in a sum not to exceed Five Hundred Dollars ($500.00) for each offense and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 4. The fact that the present ordinances and regulations of the City of the Colony, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the inhabitants of the City of The Colony, Texas~ creates an emergency for the immediate preservation of the public business, property, health, safety, and general welfare of the public which requires that this ordinance become effective from and after the date of its passage and it is accordingly so ordained.
