HomeMy WebLinkAboutOrdinance No. 725 CITY OF THE COLONY, TEXAS ORDINANCE NO. 725 AN ORDINANCE OF TNE CITY OF THE COLONY, TEXAS ANENDING THE CODE OF ORDINANCES OF THE CITY BY AMENDING CHAPTER 19 OF THE CODE RELATING TO TRAFFIC; AMENDING SECTION 19-12 RELATING TO PARKING REQHIREMENTS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER ORDINANCES OF THE CITY RELATINC TO TRAFFIC EXCEPT TO THE EXTENT OF CONFLICT HEREWITH; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; DECLARING AN EMERGENCy AND PROVIDING AN EFFECTIVE DATE NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section [. That Chapter [9 of the Code of Ordinances of the City of The Colony, Texas (the "City") relating to traffic is hereby amended in the following particulars, and that all other chapters, sections, subsections, paragraphs, sentences, words and phrases of said Code are not amended but are hereby ratified, verified, approved and affirmed: A. That Section ]9-]2 relating to parking requirements is hereby amendeded by adding the following: "Sec. 19-12. Parking R~equirements. "(j) It shall be unlawful and a violation to psrk any vehicle, except a United States Postal vehicle, within ten feet (10') of a United States Postal box, between the hours of 8:00 a.m. and 6:00 p.m., Monday through Saturday, except on National holidays, where signs are erected or curbs painted giving notice that parking there is prohibited." Section 2. If any section, article paragraph, sentence, clause, phrase or word in his ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such bold· valzd~ty of the remaznxn~ Dortin.o ~ ~. rng ~hall not affect: the Counczl hereby declarer -it ~-i%~z tn~s ordinance; and the City · . . . u~a ha~e p~ssed such remaining portions of th~s Ord~nayce despzte such znvalzdrty, whxch remazning port~ons shall remazn ~n full force and effect. Section 3. That this ordinance shall be Cumulative of all other ordinances of the City affecting traffic and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. Section 4. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be subject to a fine in s sum not to exceed Two Hundred Dollars ($200.00) for each offense and a separate offense shall be deemed Committed upon each day during or on which a violation occurs or continues. Section 5. The fact that the present ordinances and regulations of the City of the Colony, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the inhabitants of the City of The Colony, Texas, creates an emergency for the immediate preservation of the public business~ property, health, safety, and general welfare of the public which requires that this ordinance become effective from and after the date of its passage and it is accordingly so ordained.
