AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AUTHORIZING THE CITY MANAGER TO ENTER ~NTO A CONTRACT FOR THE RENOVATION OF ~;~E ~?a~tO~ ON~ IN THE AMOUNT OF $~D4~Q~4~D.OO ATTACHING THE APPROVED FORM OF CONTRACT AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIl, OF THE CITY OF THE COLONY, TEXAS: Section 1. ARTICLE 1 THE CONTRACT DOCUMENTS The Contract Documents consist of this Agreement, Conditions of the Contract (General, Supplementary and other Conditions), Drawings, Specifications, Addenda issued prior to execution of this Agreement, other documents listed in this Agreement and Modifications issue0, after execution of this Agreement; these form the Contract, and are as fully a part of the Contract as if attached to this Agreement or repeated herein. The Contract represeots the entire and integrated agreement between the parties hereto and supersedes prior negotiations, representations or agreements, either written or or-~t. An enumeration of the Contract Documents, other than Mod/fication.s, appears in Article 9. ARTICLE 2 THE WORK OF THIS CONTRACT Tbe Contractor shall execute thc entire Work described in the Contract Documents, except to the extent specifically indicated in the Contract Documents to be the responsibility of others, or as follows: The parking on the south side of the existing building will be constructed by The City oI' The Colony during construction of Fire Station No. I. All landscaping by ~he City oI' The Colony. Removal of all trucks and equipment to be by The City of The Colony Fire Department prior to starting construction. ARTICLE 3 DATE OF COMMENCEMENT AND SUBSTANTIAL COMPLETION 3.1 1'he date of commencement is the date from which the Contract Time of Paragraph 3.2 is mc~asured, and shafi be the date of this Agreement, as first written above, unless a different date is stated below or provision is made for the date to be fixed in a notice to proceed issued by the Owner. Uoless the date of commencement is established by a notice to proceed issued by the Owner, the Contractor sh',dl notify the Owner in writing not less than five days before commencing the Work to permit the timely/'ding of mortgages, mechanic's liens 3;2-The Contr;t'ctor shall achieve Substantial Completion of the enti~e Work not later thafi July 12~ 1989~ (150 calendar days). The amount of $100.00 per calandar day for the General Construction Contract will be deducted f~.om the money due or to become due including administrative and inspection costs. Should the General Construction Contract be completed ahead of schedul% the amount of $100.00 per day will be paid by the Owner to the Contractor in addition to the Construction amount as specified in the Owner/Contractor agreemeut.
