AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING THE CODE OF ORDINANCES OF THE CITY BY AMENDING CHAPTER 6, ARTICLE II RELATING TO SIGNS; AMENDING SECTION 6-21, DEFINITIONS~ ADDING SECTION 6-26 RELATING TO NONCONFORMANCE$ PROVIDING A SEVERABILITY CLAUSEi PROVIDING THAT THIS ORDINANCE SH~?J. BE CUMULATIVE OF ALL OTHER ORDINANCES OF THE CITY RELATING TO SIGNS EXCEPT TO THE EXTENT OF CONFLICT HEREWITH~ PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2000.00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES~ DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That Chapter 6, Article II of the Code of Ordinances shall be amended in the following particulars: Section 6-20 - Definitions Section 6-20 shall be amended by adding the following: A. Special. Event - Any self supporting sign no more than nine {9) square feet in area, specifically announcing one special event sponsored by schools, churches and organizations of public interest, special Event Signs shall be constructed of weatherproof materials, and shall be professional in appearance. B. Special Event Directional - Any self supporting sign no more than four (4) square feet in area displayed on the day(s) of the event for movement control supplemental to Special Event Signs. Section 2. That Section 6-26 shall be added as follows: "Section 6-26 A. Exceptions - Temporary promotional signs-display in public rights-of-way. This exception shall be limited per each organization to four (4) times per calendar year with a maximum of fourteen (14) days each. Signs shall be located as determined by the traffic engineer or his representative. B. Display Limitations Special Event Sisns. No more than five (5) signs shall be displayed per each event. Special Event Directional Signs. No more than ten (10) signs shall be displayed per event. Signs shall not be displayed in centerline medians of any street or public driveway. C. Permit Required No sign shall be displayed until permit for such has been issued. An application for permit shall be filed no less than five (5) days prior to the first day of display, and shall include a written statement to the Building Inspection Department guaranteeing the removal of all signs following the event. No fee is required. Section 3. If any section, article paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4. That this ordinance shall be cumulative of all other ordinances of the City affecting signs and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. Section 5. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be subject to a fine in a sum not to exceed Two Thousand Dollars ($2000.00) for each offense and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 6. The fact that the present ordinances and regulations of the City of the Colony, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the inhabitants of the City of The Colony, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety, and general welfare of the public which requires that this ordinance become effective from and after the date of its passage and it is accordingly so ordained.
