CITY OF THE COLONY, TEXAS
AN ORDINANCE OF THE CITY OF THE COLONY,
TEXAS, ORDERING AN ELECTION OF THE OUALIFIED
VOTERS OF SAID CITY ON THE FIFTH DAY OF MAYv
1989v FOR TEE PURPOSE OF ELECTING A MAYOR~
AND THREE COUNCILMENBERS FOR SAID CITY
WHEREAS~ the term of office of the Mayor, and three (3)
Councilmembers presently on the City Council expires May 6, 1989;
and
WHEREAS, it is hereby found and determined by the Mayor,
acting in his official capacity, and the City Council acting as
the governing body of the City that it is in the best interest of
the City and its citizens to hold an election for the purpose of
electing a Mayor, and three (3) Councilmembers to the City
Council Places 1, 2 and 3; and
WHEREAS, Vernon's Ann. Civ. St., Art. 978 authorizes such
election; and
WHEREAS, V.A.T.S. Election Code, Art. 2.0lb specifies the
date on which such elections may be held;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS:
Section 1. That a general election be held in and
throughout the City of The Colony, Texas on Saturday, May 6,
1989, for the purpose of electing a Mayor, and three (3)
Councilmembers to serve on the City Council Places 1, 2 and 3;
and
Section 2. That the City election precincts for this
election shall consist of the territory situated within the
various Denton County election precincts located within the
corporate limits of the City and bearing the following numbers,
and the polling place and officers of said election shall be as
follows, to wit:

ABSENTEE BALLOT BOARD PRESIDING JUDGE

The Presiding Judge shall appoint not less than two (2) nor
more than six (6) qualified election clerks to serve and assist
in the conduct of the election, providing that if the Presiding
Judge named above actually serves as expected, the Alternate
Presiding Judge shall be one of such clerks.
By passing this Ordinance, the City Council of said City
approves and concurs in the appointment of the aforesaid election
officers.
Section 3. That voting at and on the date of said election
shall be by paper ballot or by any other method as approved in
the Texas Election Code, as amended, and said ballots shall be
printed in accordance with the Texas Election Code, as amended.
Section 4. No person's name shall be placed on the ballot
as a candidate for the position of Mayor or Counci]member of the
City Council until such person has filed his/her sworn
application and affidavit as provided by the laws of the State of
Texas and the Charter of the City of The Colony, Texas with the
City Secretary at least forty-five (45) days prior to the
election date.
Section 5. All eligible City of The Colony voters shall
cast their ballots at the aforementioned Polling Places. The
polls shall be open between 7:00 o'clock a.m. and 7:00 o'clock
p.m. on May 6, 1989.
Section 6. AS to absentee voting for said election, paper
ballots shall be used, and such absentee voting shall be
conducted by the City Secretary, who is hereby appointed the
Clerk for Absentee Voting, at the City Secretary's Office at City
Hall, City of The Colony, Texas. For the period absentee voting
for said election is permitted by law, the Clerk shall keep said
office open for absentee voting during regular working hours of
each workday. For the purpose of additional absentee voting the
Clerk shall keep said office open Saturday, April 29, 1989 from
10:00 a.m. to 2:00 p.m. The absentee ballots for said election
shall conform to the requirements of the Texas Election Code, as
amended, and in so doing shall permit the voters to vote for a
Mayor and three (3) Councilmembers, Places 1, 2 and 3. Each
elector shall place an "X" in the space provided beside each
candidate's name that he/she wishes to vote for, provided,
however, that no elector shall vote for more than one (1)
candidate for Mayor and Councilmember in each Place.
Section 7. The election materials enumerated in V.A.T.S.
Election Code, Art. 1.08a, shall be printed in both English and
Spanish for use at the polling place and for absentee voting for
said election.
Section 8. Notice of said election shall be given by
publishing the notice at least one time, not more than twenty-
five (25) days nor less than ten (10) days before the election,
in at least one newspaper regularly published in the City, and a
copy of the notice shall also be filed with the City Secretary
and another copy shall be posted on a bulletin board in the
office of the City Secretary, at least twenty (20) days before
the election. The City Secretary of the City of The Colony,
Texas shall keep a copy of the notice as published, together with
the name(s) of the newspaper(s) and date or dates of publication.
