AN ORDIN/~ICE O~ THE CI~¥ O~ ~HE COI.~I~ TEXAS ANENDING THE CODE OF ORDINANCES OF THE CITY BY AMENDING CHAPTER 2, ARTICLE I; AMENDING SECTION 2-?; AMENDING SECTION 2- 8,; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That Chapter 2, Article I, Section 2-7 of the Code of Ordinances shall be amended to read as follows: ARTICLE I - IN GENERAL "Section 2-7 Office of the Operations Manager - Created; function. Pursuant to section 3.07 of the charter, there is hereby created an administrative office of the city to be known as the office of the operations manager. The duties of this office shall be to oversee the operations of the inspections department, public works department, water department, wastewater department, maintenance department, vehicle maintenance department and other such duties as may be assigned the office by the city manager." Section 3. That Chapter 2, Article I, Section 2-8 of the Code of Ordinances shall be amended to read as follows: "Section 2-8 Appointment and term of operations manager The operations manager shall be appointed by the city manager with the approval of the council for an indefinite term and shall report directly to the city manager as such officer's duties may require." Section 3. If any section, article paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4. That this ordinance shall become effective from and after the date of its passage and it is accordingly so ordained.
