AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AHENDING
THE CODE OF ORDINANCES OF THE CITY BY AMENDING CHAPTER
6, SECTION 1, ADOPTING TBE 1988 HNIFORM BUILDING CODE;
SECTION 6-2, ADOPTING TBE 1990 NATIONAL ELECTRICAL
CODE; SECTION 6-4, ADOPTING THE 1988 UNIFORM MECHANICAL
CODE; SECTION 6-5, ADOPTING THE 1988 UNIFORN PLUMBING
CODE; AMENDING CHAPTER 9, SECTION 2, ADOPTING THE 1988
UNIFORM FIRE CODE; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING AN EFFECTIVE DATE; AND DECLARING AN EMERGENCY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TBE
COLONY, TEXAS:
Section 1. That Chapter 6, Section 6-1 (a) relating to
adoption of the building code is hereby amended to read as
follows:
Section 6-1 (a)
"The Uniform Building Code, 1988 edition, and any subsequent
editions, of the International Conference of Building Officials,
is hereby adopted by r~ference as the building code of the city,
subject to all amendments and conflicting provisions contained in
this Code of Ordinances. A true and correct copy of said Uniform
Building Code shall be kept in the office of the city secretary
and be made available for inspection during regular business
hours.
Section 2. That Chapter 6, Section 6-2 (a) relating to
adoption of the electrical code is hereby amended to read as
follows:
Section 6-2 (a)
"The National Electrical Code, 1990 edition, and any
subsequent editions, as published by the National Fire Protection
Association, is hereby adopted by reference as the electrical
code of the city, subject to all amendments and conflicting
provisions contained in this Code of Ordinances. A true and
correct copy of said National Electrical Code shall be kept in
the office of the city secretary and be made available for
inspection during regular business hours."
Section 3. That Chapter 6, Section 6-4 relating to adoption
of the mechanical code is hereby amended in its entirety, to read
as follows:
Section 6-4
"The Uniform Mechanical Code, 1988 edition, and any
subsequent editions, of the International Association of Plumbing
and Mechanical Officials, is hereby adopted by reference as the
mechanical code of the city, subject to all amendments and
conflicting provisions contained in this Code of Ordinances. A
true and correct copy of said Uniform Mechanical Code .shall be
kept in the office of the city secretary and be made available
for inspection during regular business hours."
Section 4. That Chapter 6, Section 6-5 relating to adoption
of the plumbing code is hereby amended in its entirety, to read
as follows:
Section 6-5
"The Uniform Plumbing Code, 1988 edition, and any subsequent
editions, of the International Association of Plumbing and
Mechanical Officials, is hereby adopted by reference as the
plumbing code of the city, subject to all amendments and
conflicting provisions contained in this Code of Ordinances. A
true and correct copy of said Uniform Plumbing Code shall be kept
in the office of the city secretary and be made available for
inspection during regular business hours.
Section 3. That Chapter 9, Section 9-2 relating to adoption
of the fire code is hereby amended to read as follows:
Section 9-2
"That hereby is adopted, by reference, by the city council,
for the purpose of prescribing regulations governing conditions
hazardous to life and property from fire or explosion, that
certain code known as the Uniform Fire Code, recommended by the
Western Fire Chiefs' Association and the International Conference
of Building Officials, 1988 edition, and any subsequent editions,
save and except such portions as are hereinafter deleted,
modified or amended. Said code is made a part hereof for all
purposes the same as if fully set out at length herein. A true
and correct copy of said Uniform Fire Code shall be kept in the
office of the city secretary and be made available for inspection
during regular business hours.
Section 3. That if any section, article paragraph, sentence,
clause, phrase or word in this ordinance, or application thereto
any persons or circumstances is held invalid or unconstitutional
by a Court of competent jurisdiction, such holding shall not
affect the validity of the remaining portions of this ordinance;
and the City Council hereby declares it would have passed such
remaining portions of this Ordinance despite such invalidity,
which remaining portions shall remain in full force and effect.
Section 4. The fact that the present ordinances and
regulations of the City of the Colony, Texas, are inadequate to
properly Safeguard the health, safety, morals, peace, and general
welfare of the inhabitants of the City of The Colony, Texas,
creates an emergency for the immediate preservation of the public
business, property, health, safety, and general welfare of the
public which requires that this ordinance become effective from
and after the date of its passage and it is accordingly so
ordained.
