AN ORDINANCE CALLING TWO (2} PUBLIC HEARINGS IN ACCORDANCE WITH TEX.REV.CIV.STAT.ANN.ART. 970a OF THE MUNICIPAL ANNEXATION ACT AND SECTION 1.03, OF CBAPTER 1 OF THE HOME RULE CHARTER OF THE CITY OF THE COLONY, TEXAS, ADOPTED JANUARY 20, 1979, FOR THE PURPOSE OF CONSIDERING THE INSTITUTION OF ANNEXATION PROCEEDINGS TO ANNEX ALL THAT LOT, TRACT, PARCEL OF LAND DESCRIBED IN EXHIBIT WA" WITH THE FIRST PUBLIC HEARING TO BE CONDUCTED ON SITE ON THE 21st DAY OF March , 19 88 , AT ~4~ O'CLOCK P.M. AND WITH THE SECOND PUBLIC HEARING TO BE CONDUCTED AT THE CITY HALL, 5151 NORTH COLONY BOULEVARD, THE COLONY, TEXAS ON T~E 21st DAY OF March , 19 8--8, AT 7:30 O'CLOCK P.M., PROVIDING FOR PUBLICATION OF NOTICE; DIRECTING PREPARATION OF A SERVICE PLAN FOR INSPECTION AT THE PUBLIC HEARINGS NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That pursuant to and in accordance with Tex. Rev. Civ. Stat. Ann. art. 970a, and Section 1.03 of Chapter i of the Home Rule Charter of the City of The Colony, Texas, adopted January 20, 1979, two (2) public hearings to consider institution of annexation proceedings to annex that lot, tract, and parcel of land described in Exhibit "A" which is attached hereto and incorporated herein as if copied in its entirety into the body of this ordinance are hereby called as follows: (a) Public Hearing on Site is set for the 21st day of March , 19 88 , at ~ o'clock p.m. (b) Public Hearing at City Hall, 5151 N. Colony Blvd., The Colony, Texas is set for the 21st day of March , 19 88 , at 7:30 o'clock p.m. Section 2. All interested persons shall be given the opportunity to be heard at said public hearings which shall be conducted and held not more than forty (40} days nor less than twenty (20) days prior to the institution if annexation proceedings. Section 3. NOTICE OF PUBLIC HEARING (a) Notice of this public hearing shall be published in a newspaper having general circulation in the City, and in the territory proposed to be annexed. Said notice shall be accomplished by publication of this ordinance in its entirety, including Exhibit "A" at least once in said newspaper not more than twenty (20) days nor less than ten (10) days. prior to each public hearing. (b) Additional notice by Certified Mail shall be given to railroad companies, if any serving the City and on the City's tax roll where the right of way is located within the territory to be annexed. Section 4. The City Council hereby directs the City Manager to prepare a service plan that provides for the extension of municipal services into the area to be annexed in accordance with Section 10 of Tex. Rev. Civ. Stat. Ann. art. 970a. Said service plan shall be made available for inspection and explained to the inhabitants of the area to be annexed at the public hearings. Section 5. Evans Survey, Abstract No. 397, the David Andrews Survey, Abstract No. 18, and the Benjamin Schoonover Survey, Abstract No. 1208, In Denton County, Texas, and being more particularly described as follows: COMMENCING at a point In the south right-of-way line of F.M. Highway 544 said point being In the most westerly line of the Samuel B. Evans Survey; THENCE North01°55'00" West along said line of Evans Survey for a distance of 1,443.57 feet to a polnt~ THENCE leaving said Survey line, North 78°45'15" East a distance of 157.00 feet; THENCE North 60050'35'' East a distance of 71.84 feet to a polnt~ THENCE North 72o48'05" East a distance of 389.77 feet to a point on the centerllne of a future East]West thoroughfare, said point being the point of curvature for a curve to the left having a radius of 2,400.00 feet; THENCE northeasterly along said centerllne with said curve to the left, through a central angle of 28°40'42'' for an arc distance of 1,201.28 feet to the point of tangency; THENCE continuing along said centerllne, North 44°07'2Y'East a distance of 508.28 feet to the point of curvature for a curve to the right having a radius of 2,000.00 feet; THENCE northeasterly continuing along said centerltne with said curve to the right through a central angle of 45002'40' for an arc distance of 1,572.35 feet to the point of tang~ncy; THENCE continuing along said centerllne, North 89°10'0Y' East a distance of 300.00 feet to a point at the Intersection with the centerllne of a future North/South thoroughfare; THENCE leaving said East/West centerllne and along said North/South centerllne North 00049'57'' West for a distance of 150.00 feet to the point of curvature for a curve to the right having a radius of 2,500.00 feet; THENCE northeasterly continuing along said North/South centerllne with said curve to the right through a central angle of 04°35'19'' for an arc distance of 200.21 feet to the POINT OF BEGINNING of the herein described tract of land; THENCE North 01o48' East a distance of 700.00 feet to a point; THENCE North 88047' East a distance of 2100.00 feet to a point tn the westerly right-of-way line of the St. Louis and San Francisco Railroad; THENCE following the westerly right-of-way line of said St. Louis and San Francisco Railroad, South 06°04'55'' West a distance of 718.79 feet to a point; TttENCE departing the westerly right-of-way line of said St. Louis and San Francisco Railroad South 89°10'0Y' West a distance of 2045.55 feet to the POINT OF BEGINNING and CONTAINING 33.60 acres of land more or less. 9132.00 PR2/8g/DI-029 EXHIBIT
