AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING
CHAPTER NINE OF THE CODE OF ORDINANCES OF THE CITY BY
AMENDING SECTION 9-1 RELATING TO THE BUREAU OF FIRE
PREVENTION; SECTION 9-2 ADOPTING THE 1985 UNIFORM FIRE
CODE; SECTION 9-5 RELATING TO STORAGE OF FLAMMABLE OR
COMBUSTIBLE LIQUIDS; AND DELETING SECTION 9-7 RELATING
TO STORAGE OF EXPLOSIVES AND BLASTING AGENTS; PROVIDING
A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND
DECLARING AN EMERGENCY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS:
SECTION 1.
That Section i (b) of Chapter 9 of the Code of Ordinances
shall be amended to read as follows:
(b) "The fire marshal in charge of the bureau of fire
prevention shall be appointed by the Fire Chief on the basis
of examination, education and experience to determine such
person's qualifications."
SECTION 2.
That Section 2 of Chapter 9 of the Code of Ordinances shall
be amended to read as follows:
"There is hereby adopted by the city council, for the
purpose of prescribing regulations governing conditions
hazardous to life and property from fire or explosion, that
certain code known as the Uniform Fire Code, recommended by
the Western Fire Chiefs' Association and the International
Conference of Building Officials, 1985 edition, save and
except such portions as are hereinafter deleted, modified or
amended. Said code is made a part hereof for all purposes
the same as of fully set out at length herein. A true and
correct copy of such code as amended, shall be on file in
the office of the city secretary and available for
inspection by any person at any time during regular business
hours.
SECTION 3.
That Section 5 (a) of Chapter 9 of the Code of Ordinances
relating to storage of flammable or combustible liquids in
outside aboveground tanks shall be deleted in it's entirety.
SECTION 4.
That Section 7 of Chapter 9 of the Code of Ordinance
relating to storage of explosives and blasting agents shall be
deleted in it's entirety.
SECTION 5.
That if any section, article, paragraph, sentence, clause or
phrase of this ordinance or application thereof to any person or
circumstance is held invalid or unconstitutional by a Court of
competent jurisdiction, such holding shall not affect the
validity of the remaining portions of this ordinance, and the
City Council hereby declares it would have passed such remaining
portions of this Ordinance despite such invalidity, which
remaining portions shall remain in full force and effect.
SECTION 6.
The fact that the present ordinances and regulations of the
City of The Colony, Texas, are inadequate to. properly safeguard
the health, safety, morals, peace and general welfare of the
inhabitants of the City of The Colony, Texas creates an emergency
for the immediate preservation of the public business, property,
health, safety, and general welfare of the public which requires
that this ordinance become effective from and after the date of
its passage and it is accordingly so ordained.
