HomeMy WebLinkAboutOrdinance No. 538 CITY OF THE COLONY, TEXAS ORDINANCE NO. 538 AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING THE CODE OF ORDINANCES BY AMENDING SECTION 24 OF APPENDIX A - ZONING R~LATING TO AMENDMENTS; BY AMENDING SUBSECTION 24-101(5} RELATING TO PROCEDURES; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCy AND PROVIDING AN EFFECTIVE DATE NOW, TREREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That Section 24-101{5) shall be amended to read as follows: (24-101) Procedure "If a proposed amendment, supplement or change has been denied by the Planning and Zoning Commission, or if a protest against such proposed amendment, supplement or change has been filed with the City Secretary, duly signed and acknowledged by the owners of twenty (20) per cent or more, either of the area of the lots included in such a proposed change or those immediately adjacent in the rear thereof extending two hundred (200) feet therefrom or those directly opposite thereto extending two hundred (200) feet from the street frontage of such opposite lots, such amendments shall not become effective except by a three- fourths (3/4) vote of the City Council. Section 2. If any sentence, article, paragraph, clause, phrase or word in this Ordinance, or application thereof to any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not effect the validity of the remaining portions of this Ordinance; and the City Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 3. The fact that the present ordinances and regulations of the City are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this Ordinance shall become effective from and after the date of its final passage and publication as provided by law, and it so accordingly so ordained.
