ORDINANCE NO.
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS
AMENDING CHAPTER 6-1 OF THE CODE OF
ORDINANCES BY AMENDING SECTION 307 (F} OF THE
UNIFORM BUILDING CODE R~LATING TO CERTIFICATE
OF OCCUPANCy; AMENDING SECTION 6-115 RELATING
TO LICENSE AND INSPECTIONS FEES; PROVIDING A
PENALTY; PROVIDING A SEVERABILITY CLAUSE;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIV~ DATE
NO~, THEREFORe, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS=
Section 1. That Chapter 6-1 adopting and amending the
1985 Uniform Building Code is hereby amended to read as follows:
"Section 307(f). Group R Occupancy.
Upon a change of ownership or a change of occupancy of
a non-residential unit or a residential dwelling unit, the
owner, his agent or the occupant shall request a Certificate
of Occupancy from the Building Official of the City of The
Colony..."
Section 2. That Section 6-115 of the Code of Ordinances
be amended by adding the following:
Section 6-115 License and Inspection Fees
"The fee for the first Certificate of Occupancy inspection
shall be $25.00; The fee for any additional inspections
thereafeter, if required, JHAAC ~
Section 3. Any person violating any of the provisions of
this Ordinance shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be fined in a sum not to exceed Five
Hundred Dollars ($500.00) for each offense and a separate offense
shall be deemed committed upon each day during or on which a
violation occurs or continues.
Section 4. If any sentence, article, paragraph, clause,
phrase or word in this Ordinance, or application thereof to any
person or circumstances is held invalid or unconstitutional by a
Court of competent jurisdiction, such holding shall not effect
the validity of the remaining portions of this Ordinance; and the
City Council hereby declares it would have passed such remaining
portions of this Ordinance despite such invalidity, which
remaining portions shall remain in full force and effect.
Section 5. The fact that the present ordinances and
regulations of the City are inadequate to properly safeguard the
health, safety, morals, peace and general welfare of the
inhabitants of the City creates an emergency for the immediate
preservation of the public business, property, health, safety and
general welfare of the public which requires that this Ordinance
shall become effective from and after the date of its final
passage and publication as provided by law, and it so accordingly
so ordained.
