AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER 12 RELATING TO UTILITIES BY AMENDING SECTION 10 OF THE WATER AND SEWER CODE AS ADOPTED BY ORDINANCE NO. 449 ON THE 29TH DAY OF SEPTEMBER, 1986; PROVIDING AN ENFORCEMENT CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY OF FINE OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSB AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION~____..~__~ OCCURS; DECLARING AN EMERGENCY AND PROVIDING · AN EFFECTIVE DATE NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That t0 of the Water and Sewer Code as adopted by Ordinance No. 449 on the 29th day of September, 1986 shall be amended to read as follows: Section 10. Other Fees and Charges "Section 10.2 There shall be assessed a fee of twenty ($20.00) for re-con~cting a customer to the City water or sewer system." Section 2. The enforcement of this Code shall be by the City Council of the City of The Colony, Texas or through any person whom it may designate provided that such person is employed as an employee or under a contract with the City. Section 3. Provisions of' this ordinance shall be, and they are hereby, declared to be severable, and should any portion of it be declared to be invalid for any reason by a court of competent jurisdiction, such holding shall not effect the remaining portions thereof. Section 4. Any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Hundred Dollars ($200.00) for each offense and a separate Offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 5. The fact that the present ordinances and regulations of the City are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this Ordinance shall become effective from and after the date of its final passage and publication as provided by law, and it so accordingly so ordained.
